MINUTES OF REGULAR MEETING BEVIL OAKS CITY COUNCIL JANUARY 15, 2002 The meeting was called to order and the invocation was given by Erin Galloway, Mayor. Council Members Present: Erin Galloway, Tom Cooley, Pete Friloux, Jane Hebert, Kenny Kidd, Mayor Galloway called Executive Session Pursuant To Article 551.074 OfThe Local Government An audit of financial records by an accredited independent accountant and Pete Friloux was appointed Tommy La Rousse, Anna Beth Leger Code. Council Treasurer effective after the audit. Building Permits -. John Milam M/M/2/C: To accept application. Cooley/Leger Motion Carries Drainage And Roads - Mayor Galloway met with Doug Cannant ofl Drainage District Six. Mr. Cannant proposed a revision of the drainage plan on Sweetgum. This will involve receiving permission of four households to change their easements. This plan will help the drainage on Sweetgum. After the work is completed Sweetgum will be paved. Mr. Cannant also has a plan for the drainage in the Niagra and River Bend area. This will not involve culverts but will involve digging a Improvements on. Davida and Niagra will be continued when the weather becomes more warm and dry. Marshal Carrico spoke with Paul Truax of Precinct One. Mr. Truax stated more material would be needed to stabilize Davida and Niagra at an extra expense to the city. Mayor Galloway stated she would talk with Mr. Truax as she was was not aware of additional expenses for these roads. Mr. La Rousse reported that Nathan Hanson requested a white stripe be painted down the middle of Sweetgum. The marshal asked ifDD6 had mentioned to erosion problem near the Gundolfhome. The Ms. Hebert asked ifthe light on Inwood had been moved to its correct location. The marshal and Mr. trench out to Highway 105. This plan will be less expensive. mayor will talk with Mr. Cannant about this issue. Cooley reported the light moved to the correct location. M/M/2/C/: Pay Entergy for light installation Leger/Cooley Motion Carries Tom Cooley asked Gary Stevenson of BOMUD ifthe pipe has been moved for the Sweetgum project. Mr. Stevenson stated the pipes would be moved when DD6 moves the culverts. Bids For Garbage Removal - Mayor Galloway stated this would come under Mr. Friloux'sa authority. Ads should be placed in the paper in March to begin taking bids. The contract with Waste Management ends in September. A new contract should be ready by July. The marshal suggested giving citizens an option to use the company's containers. The mayor will contact Waste Management for a: reimbursement as Bevil Oaks did not receive garbage pick up on Christmas Day and New Years Dog Ordinance 125 - Paul Ford wrote a letter the council, which was read by the mayor. This letter regards dogs scattering garbage. He asked that the council to enforce this ordinance. Mayor Galloway stated any dog without a collar is considered a stray will be picked by the Jefferson County animal control officer. Ms. Hebert stated that all dogs are required to have rabies shot. She suggested the city notify citizens oft this in a future newsletter. Leigh Carrico reported the Jefferson County Sheriff Department is considering a new ordinance. Ifa dog bites, there will be a mandatory quarantine at a veterinarian' s office or at the Beaumont Animal Control Department at the owner's expense. Several animals have been shot in Bevil Oaks. This is considered cruelty to animals. Valerie Cooley stated it is the owner's responsibility when dogs get into trash cans. She suggested citizens be educated about neutering/spaying animals, collars, shots and confining animals in estrus. Mr. Cooley read an article regarding cruelty to animal's leads to more serious crimes such as homicide, sexual assault, and battery of women. Chelsey Kidd, suggested a city-wide registration of animals. Day. M/M/2/C: To study dog (pet) ordinance to revise in the future. Kidd/Friloux Motion Carries City Hall Improvements - Ms. Leger received information on office safes. Mr. Friloux suggested a new office chair for the computer. Portable buildings are out of the city budget. Mr. Gundolf suggested storing reçords, equipment, etc,upstairs. Shelves would need to be built. Deborah Richey-Galler, City Secretary, asked for conformation of early voting hours for the City election. John Gundolph asked for the erosion near Shipley and Thousand Oaks to be corrected. The plan is to move the easement that runs through the front ofMs. Toups' yard-r rerouting the easement to run between the Toups and Holton yards. Ms. Toups and Mr. Holton do: not want an open ditch. They want culverts and a closed ditch. The cost would be approximately $23,000.00 to the city. This will be three - fourths ofone year's road use account. Residents are not required to give up easements. The city can leave the easements where they are and there might be a drainage problem. Another option will be to leave the easements where they are and add larger culverts and clean outs, which would cost the city approximately $16,000.00, The last option would be to do nothing. Ms. Toups would not attend the council meeting to voice her opinion. This is area holds water and keeps residents from leaving Bevil Oaks. During tropical storm, Allison, flooding in this area caused the volunteer evacuation. A heavy rain will also cause problem in this area. The elevation plan would be approximately eight inches. He has sent information by registered mail. He then began calling Austin for this information. He has received no response. Penalties will include loss of all insurance, supplements, and grants. Precise and exact rules must be enforced. This will be costly, but the city has no choice ini the matter. Leger/Friloux Ralph and Lisa Massey of Wastech spoke on the garbage collection. They have completed two Pat Barrett of White Acre, addressed the council and residents regarding seismic testing. The company offered to pay the city $25,000 for the use of cables to run along city streets. Maps were available to show roads that would be affected. Consultants will be accessible, with permission, to take photographs and readings inside and outside ofhomes. After testing, any damage will be addressed by additional photographs and readings to determine any harm. White Acre proposes to use five (5) pound shots to be used past 500 feet. The cables would lie by the streets for approximately 3 weeks. Work would begin in January at the earliest. Mr. Cooley stated any vibration; blast will cause a shift in slabs. The shift may not occur immediately, but it would occur. Water wells are another concern for damage. Mr. Williams, of WesternGeco spoke of shooting in the Baytown area with five and one half pounds (5.5) within 400 (four hundred) feet of! homes without any damage. Mr. Cooley asked for proof ofnoj problems in Baytown. Mr. Williams answered, with the client's permission; he could provide articles and a city permit. Copies of permits for seismograph testing were passed out. Council and Marshal Carrico questioned the amount of shot to be used, and the proximity to landowners and the City of Bevil Oaks. Tom Cooley, stated, regardless of landowners approval, no shots would be allowed without approval oft the City Council. He also said, after the last testing, he had property damage. He immediately called the representative he had spoken with. The man had checked out of the hotel, and could not be reached. The marshal stated after the last testing, two damage cases were presented to the opposing attorneys and were denied. Tom Cooley informed Mr. Barrett, he was the building inspector. Mr. Cooley said to be as fair as possible, one: must look at the situation one on one, to make the right decision. He feels this is a temporary situation. Mr. Cearley stated his sympathy for this family, but by approving this mobile home without a time limit, Council has acted against the ordinance. M/M/2/C: Leger/La Rousse Drainage And Roads: Tom Cooley and Jane Hebert stated residents must clean their ditches and culverts. Mr. Cearley had spoken with Mr. Nunez. Water drains to his yard, and comes very close to his house. The correct procedure to have ditches cleaned out is to complete a work order from the city. Itis his belief that many residents do not want their ditches cleaned out. Mrs. Hebert mentioned the problem area near the Shower's home has not been corrected. Mr. Cooley asked Council and Citizens to locate these areas and to turn in work orders. Bud Meridino asked about the 1994 ruling calling for a minimum 18 inch culvert. He recently added 18 inch culverts to his ditch. He stated Council approved 15 inch culverts for his neighbor. He met with Commissioner Cokinos, and was shown a letter from the city allowing for the 15 inch culverts for Mr. James Crane. He said Mr. La Rousse had signed this letter. Mr. Meridino was informed all work orders are signed by the Mayor, and not by a Council Member. Jim Cearley asked if an engineer came to the site. Mr. Meridino said the Commissioner stated he, nor anyone from his office had anything to do with this issue, that it was completely a Cityruling. He did state the county had brought 15 inch culverts to the Crane residence. Mr. Meridno was informed work orders are not presented before Council. Building Permits are presented during meetings. Jim Cealrey questioned what the city should do about the 15 inch culvert. Mr. Cooley said all culverts must be 18 inch minimum toj prevent bottlenecks. She also stated she was not happy when Doug Cannat, DD6 engineer, had large culverts placed by his home at River Oaks Blvd. and Mrs. Milam discussed the curve on Sweetgum near Capital. She asked ifs signs could be errected. Pete Friloux stated the recent automobile accident occurred on his property. He further stated he hoped irresponsible drivers will stop driving 60 miles per hour. He has property damage from this wreck and is concerned for his family's safety and future damage. He doubts signs will stop these drivers. Tommy La Rousse told Mrs. Milam he had Mr. Friloux stated the problem in this area on Sweetgum, is primarily teenagers and young adults. He believes education and speeding tickets will help this situation. Mrs. Hebert said reflectors should help, along with a new white stripe. Mr. Cooley spoke of a neighbor who ran a stop sign while speeding, while he was trying to stop the driver. Mrs. Leger said the city needed to create the municiple court to access fines and community service. Mrs. Leger stated the Marshal had hesitated in giving tickets because many drivers have them dismissed.
