D. Hilton Attomey atI Law, LLÇ April 11, 2023 City of Saluda 6EMin St. Saluda, NC28773 Dear City of Saluda, RE: Solid Waste Ordinance- - Letter Read at City Commisioners.ering on 4/10/23 Iam here as a Saludal homeowner, more than part time resident, andj patron to all local restaurants: and1 bars tos speak about the dumpsters located downi the alleyway, closestt tos patio area of the) Brew Depot. First, I'di like tot thank the city for taking the rolling trash cans offMain St.I often) hadt to dodge them, on my aftemoon: walks. ThoughIn never formally complained about them, I understand why they neededt tot be moved. Ithank the city fort their removal. Ia am aware that thei new solid waste ordinance" was publicly talked about and voted on over a 4-month period. Ia am disappointedi in myself thatl I was unaware oft these discussions. r'lld certainly pay more attention going forwardi tot the emailed agendas and be more present. I'mj proud oft the city for takingt thei initiative to come up with ai new plan. However, ideas that seem well thought out and planned onj paper sometimes end up: not working correctly once: they arej puti inj place. Thisis Sincet theiri installation, Ihave personally witnessedi improper use, ani increase ini insects and smells, children touching them, and ofo course the aesthetic blight that these dumpsters bring toa once serene gathering area. After Iemailed all ofs youl last week with my concerns, Imet with City Manager Orr: and Commissioner. Marion, Wel hada a1 positive meeting, discussing potential relocation oft the dumpsters and overall issues with all dumpsters located in town. We also discussed: ideasi ifthey were tos stayi inj place. Iwould liket tot thank both for their time. I'd also liket tol point out that] Id can tell the city is trying tol help by telling restaurants to use certain dumpsters and! by having more: frequent pick-ups. This certainly shows that the cityi isi investedin making this right and1 better for all.I Iwas toldi ini that meeting that prior tot the dumpsters being delivered, everyone going tol be: affectedi by them was sent al letter andi most oft them were one oft thoset times. russ.hiltonlaw.com I www.thiltanlaw.com Board Of Commissioners Regular Scheduled Meeting 410-2023-4/102023 3 personally approached byt the city. Unfortunately, this is not true.. I've personally spoken with or have on good authority, that most folks never received al letter or aj personal visit from the city. It frustrates met that at least 61 residents, 21 businesses, and 3 property owners hadi noi ideat this was coming untilt the dumpsters were dropped off andi individual bins were taken away. Fromi this point forward, Iaskt the city to please be more transparent andi forthcoming by reaching out to ALL1 those directly affected by change. Yes, they all should1 have been more aware by coming to city meetings. But! please don't assume everyone willl know whati to expect by word ofi mouth. Being upfront with people by reaching out creates a sense oftrust and security thati isn't currently inj place. Ithink the city should strive for thist trust with ALLI residents and businesses. As fort the dumpsters being located within feet oft the back patio oft the Brew Depot, here The dumpsters arej precariously hanging over the. building below. As they continuet tol bej pushed back against thei flimsy metal posts holding them inj place, the hilli is eroding more. Though I'ms sure. Emily and Chamblee don'tn mind getting new bathrooms out the deal, would hate tos see someone get hurt and myt taxes go upi to cover amore expensive liability insurance premium after a1 terrible Sanitationi is ai majori issue. Ihave already witnessed flies being more prevalent around the back patio oft the pub witht the dumpsters right there. Ican'twait1 tos see what thes summer months bring... Ihave already been in touchy with thel health department aboutt this. Unfortunately, their immediate answer is tos start issuing warning and docking points from all area restaurants and' bar grades until the city does something about it. certainly do not think thati is fairi for restaurant. and! bar Inr myi moeting, it was discussed that they were placed back there "out ofs sight" to deter people from using them for their personal trash.' Their use by non- commercial. andi non-immediate residents has already been witnessed on multiple odcasions bothl late at night and early int the morning, whent therei is no one1 there toj police them. Obviously, no matter where they are placed, without locks, it invites people outside oft thei immediate vicinity to use them. Ihave spoken toi more than al half dozen employees, the ones that take out the trash fort the purple onion, wakey monkey, and the brew depot. They all dislike their placement. You are in violation ofs your own ordinance and1 the city needs to immediately build: fences and gates around all oft them. Asf for ai resolution tot the issue ofthe dumpsters within ai few feet of where Ieati takeout and visit with my friends, Ibelieve that the best and only way tot resolvet thisi is to move them.I think having the dumpsters placed on Church Street, behind the required screen with coded locks would be morel beneficial and ane easier location for all surrounding businesses and residents. I also believet that they would be less bothered by visitors ift they were away from an areat that promotes gathering and morei in sight of anyone coming by. Idoi not believe thatl keeping the dumpsters wheret they are, eveni ift they are behind af fence: and gate, would resolve the issue. To build ai fence around them you) would have to pullt them out farther. This wouid makei it impossible for trash truoks, emergency vehicles, grease trucks, large delivery/work trucks, food truoks, and trailers to get downi the baok alley. Pulling them out: farther would also pull the Ifs you put a dumpster within 5f feet ofi my back door, Iwould be beside: myself.
