Larry Rhoades read a letter from the Regional Water Quality Control Board dated October 6, 2023 - "Inadequate Industrial Waste Stream Treatment/Manager - the current wastewater treatment plant is designed and operated to effectively treat domestic waste, but not the industrial waste stream generated by the various documented industries operating within the prison. These Cal PIA industrial operations include meat packing, laundry, sewing and garment assembly, coffee roasting and lunch packing. There are several vocational training facilities on-site that generate industrial wastewater, including, janitorial training, welding and fabrication, vehicle maintenance, warehouse operations; and building maintenance which includes painting, carpentry, heating, ventilation, and Air Conditioning maintenance, and mechanical maintenance products. Data provided in CDCR's monitoring reports include that volatile organic compounds (VOC's) have been detected in the plant'se effluent, effluent storage reservoir, and groundwater underlying the storage reservoir and land applications areas." Jim Scully - commented on the October 6, 2023 letter from the Regional Water Quality Control Board, "The actual volume ofi industrial wastewater flow from the specific operations in unknown. These two Cal PIA industrial operations alone generate industrial waste stream volume that generates a significant volume of wastewater entering the onsite treatment plant. Toj properly treat all the constituents and ensure reliability of the treatment plant, the updated ROWD required by this order must propose to address the industrial and domestic waste streams by either segregating and treating the streams separately with the appropriate technology or upgrading the existing wastewater treatment train to treat for all constituents in the combined waste stream." Operations Contract for Wastewater Services - City Manager, George Lee explained that on June 30, 2023, the City signed a one-year contract with James Water Services Company for: $46,750/monthly - $561,000 annually with an annual CPI increase of4 4% per contract = $583,444 Staffi is asking for direction from staff on the following: Option #1: Direct staff to bring back amended contract with Waterstone, LLC the negotiated price of $38,000 monthly, $456,000 annually with an annual CPI increase not to exceed 4%. Savings: $127,440 over contract with an annual CPI increase not to exceed 4%. Option #2: Direct stafft to bring plant operations in house with the hiring of3 full time staff with an annual personnel budget of approximately $420,000. Consider Submitting a Measure to the Voters of the City of] Ione at November 5, 2024, Municipal Election as to whether the Office oft the City Clerk should be changed from Elected to Appointed Official - City Attorney Andy Pinasco outlined the process to change the elected Clerk to an appointed Clerk-the City Council may place a question on the ballot whether the City Clerk should be an Ifthe voters should approve the measure, the City Council would be empowered to appoint the City Clerk upon expiration of their current term. Under Government Code Section 36510, the City Council may, at al later date, adopt an ordinance vesting in the City Manager the authority to appoint the City Clerk. The appointed Ifthe majority of voters vote "no" on the question, then the position will remain elected, and the City cannot submit another ballot measure regarding the appointment oft the City Clerk for at least eleven (11) months. The City Council must hold an election to fill the City Clerk position at the end of each term. appointive office. City Clerk will serve at the pleasure of the City Council. Public Comment: Mitzi Windley -I do not understand why you wanting to be appointed rather than elected. Ithink we should have the free will to elect just like you are elected and want to know why you want to appoint someone and not leave it as elected. It has been that way for some time, Idon't feel comfortable with an appointed position because sometime personalities and agendas can come along the way and influence decisions, sO let the people ofIone decide. Larry Rhoades - the three Councilmembers want to get the control of the clerk. She knows SO much about the City, she has been longer than any ofyou and has done more for the City that any of you. I object to the wording, "shall this be an elected position or appointed."Iv would like words "elected by the people and then appointed by the Council" be added for clarification. FISCAL IMPACT: None BACKGROUND: The appropriations limit was approved by California voters inl November 1979 as Proposition 4 (the Gann Initiative) and added to the California State Constitution as Article XIII B. In 1980, the State Legislature added Division 9 (commencing with Section 7900) to TitleIoft the Government Code to implement Article XIII B. This legislation required the governing body of each local jurisdiction in California to establish an appropriations limit (also referred to as the Gann Limit) on or before June 30 of each year for the following fiscal year. The appropriations limit is based on actual appropriations during the FY 1986-87 and adjusted each year using population and inflation adjustment factors. DISCUSSION: In May of2024, the California State Department of Finance (DOF) notified the local jurisdictions of the population and price data for use in the appropriations limit calculation for Fiscal Year (FY) 2024/25. Based on said documentation from the DOF, the percentage change inj population for the City of Ione is -0.06%. The per capita personal income change forl FY 2024-25is3 3.62% over prior year. In the calculation oft the annual limit, the prior year's appropriation limit is adjusted using the percentage change inj population and the per capita personal income change, see attached calculations. WHEREAS, on July 2, 2024, the City of lone adopted Resolution No. 2024-17, entitled "A RESOLUTION OFT THE CITY COUNCIL, CALIFORNIA, CALLING. A GENERAL ELECTIONTOBE! With the extension of Foothill Blvd from Highway 104 to Brickyard Road, and the addition in the near: future oft the secondary access for Busses and Emergency service vehicles only from the back side ofI Ione Elementary School to Foothill, Brickyard Rd serves as one of our primary emergency escape routes for Ione Elementary School who at peak times has over 600 persons in attendance, along with the entire Wildflower subdivision and future Gold Village development.
