PLANNING COMMISSION MEETING MINUTES  May 21, 2024  The Planning Commission oft the City of Athens, Alabama met in regular session in the City Council Chambers on May 21, 2024 at 5:45 PM, after as short work session. The meeting was Commission members present at the meeting included Gina Garth, Rick Johnson, Rod! Herron, Venard Hendrix, Brad Mallette, and Dana Henry. Also present were City staff members Erin Tidwell, City Planner, Paige Parker, Planner, and Andrea Colburn, Administrative Coordinator. Ms. Garth opened the meeting by introducing the members of the Commission and City staff. Ms. Garth then stated that the minutes oft the April 16, 2024) Planning Commission meeting had been  called to order by Gina Garth.  submitted for approval.  Dana Henry offered the following resolution and moved its adoption:  "BE ITI RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ATHENS, ALABAMA, that the minutes for the April 16, 2024 meeting be approved." Rod Herron seconded the motion, and the vote was unanimous of the voting members present.  There being no old business to discuss, the meeting proceeded.  Public Hearings:  PH.1. Consider for recommendation to the City Council the request of Seven Points Ventures, Inc. to Rezone +/-2.4 acres of property located directly west ofU.S. Highway 31 South and approximately 940: feet south of Roy Long Road East from R-1-3 (High Density Single Family Residential District) and M-1 (Light Industrial District) tol B-2 (General Business District). Ms. Garth opened the public hearing. Ms. Tidwell described the request, stating that Staff sees no Sam Mozeb (1130 Trenton Dr. Decatur, AL) was present on behalf oft the request. Mr. Mozeb  issues with this request.  stated that he would answer any questions the Commission had. With no further questions or comments, Ms. Garth closed the public hearing. Resolution. Rod Herron offered the following resolution and moved its adoption:  BE IT RESOLVED that the Planning Commission for the City of Athens, Alabama, at its regular meeting on May 21, 2024, that the Commission does hereby recommend to the City Council the applicant's request to rezone +/-2.4 acres of property located directly west of U.S. Highway 31 South and  approximately 940 feet south of Roy Long Road East. Request ofJ Jody Wells for Minor Plat Approval ofTracts 16, 17, & 180 ofCenterpointe Crossing, a minor subdivision of +/-5.399 acres into 11 lot, located directly west ofInterstate 65 and approximately 1,750 feet north ofU.S. Highway 721 East, zoned B-2 (General Business A letter from the applicant to the Commission was provided to the Commissioners. Brad Mallette seconded the motion, and the motion passed unanimously oft the voting members PH.5. Request of Gregg Crowe to appeal thel Design Standards, per Zoning Ordinance Section 6.1.15.A, for 1428 Freeman Avenue, to allow for al building with exposed metal panels which is otherwise prohibited per Zoning Ordinance Section 6.1.12.F(6)(d) Nonresidential and. Mixed-Use Development Building Materials, Prohibited. Materials, zoned Al letter from the applicant to the Commission was provided to the Commissioners. Ms. Garth opened the public hearing. There was discussion amongst members of the Commission pertaining to similar requests made Gregg Crow was present on behalf oft the request, and spoke in favor oft the request.  in the past.  3    Scott Marshall (212 East St.) spoke to similar requests being denied int the pastt. The following resolution was put forth before the Commission:  BE IT RESOLVED that the Planning Commission for the City of Athens, Alabama, at its regular meeting on May 21, 2024, that the Commission does hereby grant the applicant's request for design standard appeal at 1428 Freeman  Avenue.  Ms. Garth asked three times ifa member of the Commission would like to make ai motion pertaining to the request. A motion was not made by any member of the Commission. Therefore, PH.6. Request ofLee Haynes for approval ofa Certificate to Subdivide for Haynes & Schrimsher +/- 0.74 acres out of 14.29 acres, located at 2456 South Hine Street, zoned Ms. Garth opened the public hearing. BE IT RESOLVED that the Planning Commission for the City of Athens, Alabama, at its regular meeting on May 21, 2024, that the Commission does hereby grant the applicant's request for a certificate to subdivide for Haynes & BE IT RESOLVED that the Planning Commission for the City of Athens, Alabama, at its regular meeting on May 21, 2024, that the Commission does hereby grant the applicant's request for a certificate to consolidate for Ennis and  Schrimsher located at 2456 South Hine Street.  Joyce McLin at 2440 South Hine Street.  Venard Hendrix seconded the motion, and the motion passed unanimously of the voting members  present. Consent Calendar:  4    6.B. Request ofJ.C. Development Company, LLC: for Final Plat Approval of Bainbridge Subdivision, Phase 2, a major subdivision of+/-2.54 acres into 181 lots, located directly west of Interstate 65 and approximately 730 feet north of Athens-Limestone Blvd., zoned R-1-5 (Single Ms. Tidwell explained the request and stated that Staff sees no issues with this request. Staff would request that approval be made contingent upon receipt oft the appropriate bonds. Ms. Garth stated that she would like to see updated recreational space and amenities requirements  Family' Townhouse Attached Residential District).  with the City's future. Zoning Ordinance.
