The following report was provided by VDOT for the Board'sreview. There was no representation from the Virginia Department ofl Transportation (VDOT) at Concrete work on Easter Street and Riegel Road was delayed due to rain and is Crews cleaned pipes on Brantley Moore Turnpike for a work order complaint. Crews addressed 24 customer service work orders and 66 scheduled work orders. Crews cleaned pipes on secondary routes in preparation for ditch-pulling operations. Crews will continue to address right-of-way issues by trimming tree limbs back away Crews will continue to pull shoulders on the proposed pavement routes that have been Crews will start to transition into spring work to include ditching operations and VDOTcontinues to address several requests brought tot them by the Greensville County Board of Supervisors regarding Reigel Road, Brickyard Road, Macedonia Road, and Blanks Lane. Several traffic engineering requests are still being reviewed and VDOT staffwill respond as requests are. received. Anticipated to start mid-June. The tree trimming contractor worked on Route 611 and work crews provided traffic scheduled for the second week of April. Crews completed a washout repair on. Route 630. from the right-of-way at various locations. awarded. shoulder pulling. Crews worked on dirt roads in the County. control. In Re: Citizens Comments The Greensville County Board of Supervisors had developed a protocol to ensure that Board meetings and Citizen Comments were productive and efficient, and that proper decorum was maintained. The Board of Supervisors wanted to emphasize that this protocol was intended to make the Board meetings and/or citizens' comments as productive as possible. The protocol is as follows: 1. Each speaker will be given three minutes to address the Board of Supervisors. The time limit will be strictly enforced. 2. Each speaker will be advised when two minutes have elapsed. 3. Each speaker will be advised when three minutes have elapsed. 4. After all comments have been made by speakers at the public hearing, the applicant will be afforded three. minutes to respond to comments made during the public hearing. 5. Each speaker will be permitted to address the Board of Supervisors only once, i.e., the three-minute opportunity to speak cannot be transferred from one speaker to another. 4 6. Mason, ChiefCommunication Dispatcher, informed the Board that the Virginia 9-1-1 Services Board has approved the Sheriff's Office FY24 Staffing Recognition Grant in the amount of $32,500.00. Sheriff. Jarratt indicated that the grant funds will be used to give all Communications Officers a one-time bonus. There are 12 full-time and two part-time Communication Offers who willl benefit from this grant. The grant is fully funded by the Virginia Department of Emergency Management (VDEM) and there is no expense to the County. The deadline for accepting the grant is June 30, 2024. Sheriff Jarratt stated that Greensville County is fortunate to have a dedicated Communications Department. He further stated they are the heartbeat for all first responders and they go beyond to perform their duties. The 150 MW Project consisted of 848 acres of disturbed acreage including the Project fenced area, collection line easements, substation/switchyard, and After the incorporation of feedback from the Planning Commission and the local community, the Rosalind Rosalind Solar has been updated to be capable of generating up to 85 MW of electricity with 460 acres of disturbed land and 992 acres of total parcel acreage (the "updated Project"). The updated Project remains located in the southern area of the County outside of Skippers, VA in District 2. The 150 MW Project included two options ofi interconnection, "Option A" and "Option B", and after additional diligence, "Option A" has been removed from the Project. The updated 85 MW Project will utilize "Option B", which remains less than one mile from the Project. Key Project Updates Key Project updates included as part of this update to reduce the Project size from 150 MW to 85 MWs, include: Reduction in Project total parcel acreage to at total of 992 acres. Reduction in total disturbed Project acreage to 460 acres. Reduction in potential capacity of up to 85 MW. Removal of "Option A" Interconnection Location. Class V Agricultural Land locatedi in the County. Reduction of impacts to the Class V Agricultural Land to 117.55 acres or 0.39 percent of the Total Reduction of impacts to land designated as Outstanding in the NHDE Forest Conservation Value Impact Model to 2.19 acres. The Project will be capable of generating up to 150 megawatts (MW) of electricity, enough to power approximately 16,500 Rosalind Solar respectfully requests that the County review and approve the Project as in substantial accord with the Greensville 2040 County Comprehensive Plan (the "2040 Comprehensive Plan") pursuant to Virginia The Project will be located in District 2 south of Skippers, VA. The solar equipment for this Project will not occupy a large footprint or cover a large percentage of the Project's landholdings. Solar panel coverage will ocupyapproximately, 30 percent oft the Project site, please see Table! 51 below for details. The Project willl have approximately 184 acres of existing and planted vegetative buffer, further shielding the Project from view. Additionally, approximately 1,100 acres will be conserved as open space and for wildlife corridors. In this manner, the Project design is consistent with the County's valued qualities of maintaining rural character and preserving open space. The Project will generate at least $14.81 millioni in directrevenue to Greensville County which includes revenue share and property taxes on land that has been reassessed at a higher value. Since this Project is being proposed after January 1, 2021 (unlike a majority of the previously approved solar projects located in the County), the County will receive an annual revenue share of up to $1,400 per MW which increases by 10 percent every five years. Additional direct revenue mayf form part ofas siting agreement in additiontor revenue share payments and property tax. Furthermore, the Project represents a capital investment of approximately $200 million into the local economy, which will create significant revenue for local service and supply As required by Virginia State Code Section 15.2-2316.7, a siting agreement will be discussed in the proper course of business, as deemed appropriate by the County. The site is situated west of Interstate 95 (I-95) and bisected by Massie Branch Road (SR 632), Moore's Ferry Road (SR 629), and Spring Church Road (SR 631). Quarry Road (SR 650) borders the site to the north. The Virginia-North Carolina statel line borders the sitet tot the south. The Project location is shown in Figure 1 below andi is detailed The Project will interconnect to the nearest existing electric transmission line. The Project's point of interconnection tot the existing transmission line is less than one mile from the Project in accordance witht the 2040 Comprehensive Plan for utility scale solar facilities siting considerations (2040 Comprehensive Plan pg. 158). The electric transmission and distribution network int the area is serviced by Virginia Electric and Power Two interconnection options, both consistent with the 2040 Comprehensive Plan, exist for this Project. Option. A consists of Parcels 44-64J and 44-70A and Option B consists of Parcels 55-36 and 54-16. The interconnection options are detailed in the Concept Plan and Property Owner Information is provided in Appendix B: and C. Option. A was historically used as al borrow pit, and Option B was used fort timber. The land to be used for the Project has historically been utilized as forested land, timber harvesting, or cropland. Most oft the land has been managed as loblolly pine (Pinus taeda) plantations subjected to routine thinning operations and timber harvesting. For detailed information on the Project parcels including landowner information, please refer to the Property Owner Information in Appendix C. Neighboring Landowner Information Landowner information for adjoining properties, along with correlating tax map numbers and addresses (if available through County GIS system), are provided in the Parcel Exhibit in Appendix D. Adjacent properties are primarily zoned as A-1 with land uses including silviculture, light industrial, agriculture, and low density residential. 2040 COMPREHENSIVE PLAN DISCUSSION The following sections provide additional details regarding the general location, character, and extent of the proposed Project andi its accordance with the 2040 Comprehensive Plan. Please note, Chapters 1,2, 4, and 10 are not considered applicable to utility-scale solar projects and therefore a detailed discussion has not been included. Conformance with Chapter 3 - Natural Environment The 2040 Comprehensive Plan outlines nine natural resources that were considered. The discussion below sets forth each criterion and howi the Project isi in substantial accordance with the applicable resources. Rosalind has procured wetland delineations to identify jurisdictional waters (i.e., streams and wetlands) sO that the Project can be designed to avoid and protect surface water resources. In addition to avoiding wetlands and streams, Strata's best management practice is to avoid land clearing or ground disturbance within 50 feet of wetlands or streams. The Project will not install PV equipment in areas containing jurisdictional waters or wetlands. However, Rosalind plans to install four stream crossings for access roads and underground medium-voltage collection lines. Prior to construction of stream or wetland crossings, Rosalind will procure the necessary permit approvals from the US Army Corps of Engineers and Virginia Department of Environmental Quality to ensure the crossings will have minimal individual and cumulative adverse environmental effects and comply with applicable laws and regulations (2040 Comprehensive Plan pg. 33). Rosalind expects to qualify for Nationwide Permit coverage for the proposed road crossings because the impacts are minimal and below the permit threshold for wetland and; stream impacts. There willl be no land disturbance within FEMA designated flood zones (2040 Comprehensive Plan pg. 33) for the construction of PV components (solar panels, racking system, above ground wiring and cables, power Prior to conducting land disturbance activities at the site, all applicable federal, state, and local permits and approvals will be procured. Strata follows a strict quality control process utilizing regular site inspections looking for deficiencies and vulnerabilities to identify and correct potential deficiencies early. This ultimately results in a site with permanent control measures in place and functioning effectively sO that construction can proceed quickly, land disturbing activities can be completed on schedule, and the site can be fully stabilized with durable vegetation. Conservation and Natural Heritage Resources The Project will conserve between1 1,086 and 1,140acres for open space, depending on whichi interconnection option is chosen. This is consistent with the 2040 Comprehensive Plan as it maintains al balance between the Project's development and the preservation of rural character, natural landscapes, and habitats (2040 Comprehensive Plan pg. 30). This unique Project design provides fora a large acreage of open space to remain conserved to serve as al long-term preservation strategy, consistent with the 2040 Comprehensive Plan. The Project willa also maintain important wildlife habitat. The Project willl have several wildlife access corridors located throughout the Project site, as shown on the Concept Plan in Appendix B. These corridors allow for wildlife movement across the Project site, across property lines, and into other open space within thel Project. The wildlife corridors connect to the existing stream and wetland corridors throughout the Project area, as well as planted and retained vegetative buffers, and undeveloped areas or conserved open spaces across the site. A substantial percentage oft the total property under option to lease or purchase, approximately 589, is expected to remain completely undisturbed or unoccupied by equipment. This land will be available to be The Project avoids Ecological Cores asi identifiedi in Map 3.4, Wildlife Habitats Map, oft the 2040 Comprehensive Plan (2040 Comprehensive Plan pg. 37). There are no outstanding (C1) or very high (C2) Ecological Cores in or within the vicinity of the Rosalind Project. The closest veryl high (C2) Ecological Cores are east of Interstate 95, ont the other side oft thel highway. Correspondence from thel Department of Conservation: and Recreation (DCR) dated September 24, 2021, indicated the project has potential to fragment Ecological Cores (C3 high, C4- moderate, and C5 - general) as identified in the Virginia Natural Landscape Assessment. However, this preliminary assessment by the DCR doesn't take the Concept Plan into account and assumes the entire area within the project boundary' will be disturbed. Furthermore, the majority of the Ecological Cores identified by the DCR withint the Project boundaryhaver recently been clearcut byt the current landowners, therebyreducing the ecological functions provided by the forest habitat. Based on the Concept Plan provided herein, the Rosalind Project will have minimal effect on the areas previously identified byt the DCR as Ecological Cores by targeting project development activities in previously logged upland areas, avoiding and preserving forested wetlands identified as Ecological Cores, and by providing wildlife corridors that connect to existing stream and wetland corridors throughout the Project area, planted and retained vegetated buffers, and undeveloped areas or conserved open spaces across the site. The Rosalind Concept Plan avoids impacts to the heighted value Ecological Cores( (C1-outstanding: and C2- -veryh high) andl limits proposedi impacts to C3-high Ecological The Project has procured studies on state and federal wildlife and natural resources to ensure the resources will be protected in accordance with the 2040 Comprehensive Plan (pg. 37). Geosyntec Consultants, Inc., completed a desktop review of state and federal wildlife and natural resources databases and an on-site habitat evaluation of the Project. An analysis of the beneficial and adverse impacts of the proposed Project utilized by wildlife (2040 Comprehensive Plan pg. 37). Cores to approximately 6.4 acres. Rosalind. Wildlife and natural resources were reviewed for species listed as threatened and endangered at the state and federal levels, within the Project boundary and at the appropriate search distances for each database. Nine state and federal natural resource databases were searched to determine the potential for the Project to affect listed species. Two species listed as threatened or endangered were identified in state and federal databases as likely to occur or having documented occurrences within or near the Project area: northern long-eared bat (Myotis septentriondlis, federally threatened, state threatened) and loggerhead shrike (Lanius ludovicianus, state A: summer acoustic presence/absence survey was completed for the northern long-eared bat within the Project area by a USWFS-approved bat biologists at AlIStar Ecology LLC. Based on the summer acoustic presence/absence. survey, the northern long-eared bats were deemed absent at the Project. The Project did not contain early successional tree species that northern long-eared prefer to roost within during the summer such as black locust (Robinia pseudoacacia) and black cherry (Prunus serotina) and this may be ar reason why the species was not found. Rosalind will continue to coordinate with the USFWS regarding bat species, as The VaFWIS report indicated loggerhead shrike has documented observations within 2-miles of the Project. The species was observed on June 15, 2009, west of the Project near Garners Mill. The loggerhead shrike prefers areas of grassland that are grazed or mowed occasionally to keep the grass short. An abundance of perching sites, such as fences, woody vegetation or hedgerows is alsoi important habitat. Approximately 786 acres, or 47%, oft the Project was recently clear-cut fors silviculture, and active timber harvesting was observed int the central portion of the Project during the habitat assessment. Much oft the remaining approximately 53% of the Project consisted of mixed hardwood forests and wetlands, planted pine forests and wetlands, agricultural crop fields, and freshwater ponds. The Project will reduce the need for use of fossil-fuel-fired electricity generation which produce the health-harming air pollutant emissions of sulfur dioxide, nitrogen oxides, and fine particulate matter (2040 Comprehensive Plan pg. 46). The Project will also reduce the generation of greenhouse gas emissions by replacing aging energy sources that produce high levels of emissions with clean, reliable, and renewable solar energy. The Project will contribute to the 2040 Comprehensive Plans effort to The Rosalind Project will operate quietly and will not disturb the surrounding community. In accordance with the 2040 Comprehensive Plan, the Project will not create unwanted, disturbing, disagreeable, or unpleasant sounds. Operational solar facilities create: a very low decibel level of sound that is negligible outside thet facility Rosalind will not produce light pollution that bothers the neighbors or detracts from the rural character of the County. This Project would not have exterior projecting lighting installed. Conformance with Chapter. 5- Quality of4 Life The Project does not negatively impact the quality of life in the County and will maintain the rural character oft the area. It does: i) not require significant County government administration or services; ii) not require social services; ii) not require additional education resources; iv) not negatively impact recreation; v) not negatively impact cultural resources; vi) not inflict burdens on local health facilities; and vii) not require additional public safety officers. The Project also provides revenue for the County to determine, in its sole discretion, what (if any) strategies to fund and support from those identified within Chapter 5 of the 2040 Solar projects are good neighbors when sited and screened well like Rosalind. This Project will be a good neighbor. This Project will not release harmful pollutants or have negative impacts on human health or the environment. As concluded in the research report titled Health and Safety Impacts of Solar Photovoltaics, included as Appendixi, ". ther negative health and safetyi impacts of utility-scale PV development were shown to be negligible, while the public health and safety benefits of installing these facilities are significant and far outweigh any negative impacts." Construction traffic and any associated impacts willl be evaluated" via atraffic study which willl be submitted with the SUP application. The Project when operating will not produce audible noise, increase traffic, or create dust or odors. The Project will be screened from sight from natural existing and planted vegetation through thei incorporation of setbacks around the perimeter of the Project. It will not impact any of the land uses surrounding the project. There will not have a significant impact on County municipal resources such as water, sewer, trash disposal or recycling. The Project will not add anys students to schools or require additional school buses and will not require protection from local law enforcement (2040 As concluded in the Property Value Impact Assessment in Appendix G, the Project site is set back from adjoining properties and there shall be no negative impact on adjacent home values, or adjacent vacant residential or agricultural land use. A vegetative buffer of at least 100 feet will be preserved or planted (as appliable) to screen the Project from adjacent properties and road frontage. There is mature timber surrounding a large portion of the site that will be preserved as vegetative buffer. In areas where the existing vegetation isn't adequate to provide the desired screening buffers, a mix of deciduous and evergreen vegetation (as approved by County staff) willl be planted to ensure there is at least a 100-foot vegetative buffer surrounding the Project. The Planning Commission, at a meeting on October 21, 2022, and the Board of Supervisors at a meeting held on December 5, 2022, previously reviewed the applicant' 's proposal as a "public utility facility" under Virginia Code Section 15.2-2232(A), and determined that the general or approximate location, character, and extent oft the proposed facility is substantially in accord with the County's Comprehensive Plan. The Planning Commission considered its recommendation to the Board of Supervisors on the SUP application at a meeting on April 9, 2024. The Board of Supervisors must now consider whether to approve or deny the application, or defer action to a future meeting. The Board of Supervisors impose conditions that will assure that the proposed use will conform with the requirements of the County's Zoning Ordinance and will continue to do so, and require a guarantee orbond toi insure that conditions imposed are being and will continue to be complied with. EXISTING CONDITIONS AND ZONING The properties subject to the application are currently zoned A-1, Agricultural District, and existing conditions consists of a mixture of crop and timber land with the land historically used for agricultural and forestry purposes. Several streams and creeks traverse the site. The future land use With respect to wetlands, the Applicant conducted a desktop study and identified wetlands potentially impacted by the development. Based upon Staff's review of the County's GIS and the Virginia Department of Conservation and Recreation's ComserveViginiaVingmn Natural Heritage designation for the application property is Rural Residential. ADJACENT AND SURROUNDING USES The application property is not proximate to any scenic byways or known historic resources. The proposed Project includes storm water recharge designs and landscape management plans which includes utilizing existing wetlands as wildlife impacts. corridors. COMPREHENSIVE PLAN CITATIONS Below are the relevant sections of Greensville County's Comprehensive Plan. Chapter 6-1 Infrastructure: Solar With the electricity infrastructure installed in the county to support the new Dominion natural gas- fueled power plant, along with relatively flat terrain and an abundance of open land, Greensville Countyis generating significant interest from thes solar industry asaprime location fortheconstruction of utility-scale solar projects. With transmission lines traversing the county, solar developers are offered relatively low capital investment costs to connect to the electrical infrastructure necessary to carry solar energy tot the power grid. Permits have been issued for 5 solar facility sites (see Map 6.3), which are in various stages ofo completion in Greensville County, as follows: Pumpkinseed Solar (formerly Meherrin Solar) - 60-megawatt photovoltaic solar energy facility Greensville Solar 80-megawatt photovoltaic solar energy facility Sadler Solar 100-megawatt photovoltaic solar energy facility Jarratt Solar-4 49-megawatts photovoltaic solar energy facility Fountain Creek Solar - 80-megawatt photovoltaic solar energy facility Utility-scale solar projects create a large footprint on the landscape and doi not directly contribute to the local economy or provide jobs for the community over the long-term. But, it can be argued that these projects docontribute to the power grid and may reduce overall rates, and can be designed for minimal visual and environmental impact. While it is possible fora local electrical cooperative such as Mecklenburg Electric Cooperative toj provides solar-generated electricity directly to local customers in the county, perhaps the greatest local impacts are property purchase and/or lease payments to property owners and the significant tax revenues generated from these projects. Certainly, property purchase and lease payments to property owners have been seen to meet and supplement, if not surpass, dwindling revenues fromagricultural. and forestry activities, and increased tax revenues from projects can be used to address public funding gaps and cost increases, deferred maintenance of infrastructure or facilities, or fund otherprojects or expansion of services in the community that may contribute to the overall quality of life. Guidance for facility siting is discussed further in the Land Use chapter (9). Chapter 9 - Land Use: Utility-Scale Solar Facilities Page 3 of12 Utility-scale solar facilities are a relatively new and emerging land use to Greensville County. As referred to in this Comprehensive Plan, a utility-scale solar facility is a facility that generates electricity from sunlight that will be used to provide electricity to a utility provider or a large private user with a generating capacity more than one megawatt (1 MW). The county's abundant and affordable agricultural and forest land, combined with its electrical infrastructure and transportation system, appear tol be attractive to the utilities industry. Half(50.4%) ofsurvey respondents encourage solar facilities as land use within the County. While thei intensity ofoperation ofthese uses is relatively benign, the scale ofthese uses is significant, and the development phases are. intensive. Many utility- scale solar facilities are located on agricultural or forested land that may have had other future land The county will consider solar facilities in districts zoned agricultural, industrial, or commercial (based on project size), with preference for brownfields. In addition to the requirements for utility- scale solar facilities within the zoning ordinance (See Map 9.2), Special Use Permit (SUP) applications for these facilities must be evaluated based upon the following criteria, with conditions imposed to mitigate potential and anticipated negative impacts, or applications denied where criteria cannot possibly be met, outright or through the requirement of reasonable conditions: 1. These rural regions are generally stable and require a high degree of protection to preserve agricultural, forestal, recreational, and open space areas. Water and sewer are generally provided by on-site wells and septic systems. The rural areas are not intended to be developed to full subdivision potential. Pursuant to Article 23, Definitions, Section 23-2-125.1c, Solar facility, utility-scale, as a facility that generates electricity from sunlight which will be used to provide electricity to a utility provider, where the site is greater than 2 acres in size and the facility has a capacity in excess of one megawatt (1 MW), the proposed use is considered to be a utility-scale solar facility. Page 5 of12 As a solar facility, the proposed use is subject to the provisions contained in Article 24, Solar Facilities. The following provisions are relevant to the project and proposed use: 24-3(d): Utility-scale solar facilities 5MW or less are not allowed in any zoning district throughout the County. Utility Scale solar facilities greater than 5MW may be permitted by 24-3(e): Utility-scale solar facilities should locate on brownfields or near existing industrial 24-3(f): The total size of Utility Scale Solar Projects shall be less than 1,000 acres with no more than 75% PV panel coverage. Total acreage shall include the acreage under panels, and shall also include all areas within the project boundaries, including areas designated as 24-3(g): Utility Scale Solar Projects must locate within one mile of an existing transmission 24-3(h): Utility Scale Solar Projects shall not be located within one and one-half (1.5) miles 24-3():The maximum total acreage of1 land in Greensville County which may be used for 24-3@): The minimum acreage of land which may be used for an individual utility scale solar 24-6(b): A utility-scale solar facility shall be constructed and maintained in substantial 24-6(c): The minimum setback from the fencing to all exterior property lines shall be 150 24-6(d): The maximum height of the lowest edge of the photovoltaic panels shall be 10 feet as measured from the finished grade. The Board of Supervisors may approve a greater height based upon the demonstration ofa significant need where the 24-6(e): The facilities, including fencing, shall be significantly screened from the ground- level view ofa adjacent properties by a buffer zone at least 100 feet wide that shall be landscaped with plant materials consisting of an evergreen and deciduous mix (as approved by County staff), except to the extent that existing vegetation or natural land forms on the site provide such screening as determined by the zoning administrator. In the event, existing vegetation or land forms providing the screening are disturbed, new plantings shalll be provided which accomplish the same. Opaque architectural fencing may be used to supplement other screening methods but shall not be the primary method. 24-6(f): The facilities shall be enclosed by security fencing on the interior of the bufferarea (not to be seen by other properties) not less than six (6) feet in height and topped with razor/barbed wire, as appropriate. The operator shall notify the County prior to application of pesticides and fertilizers. The County reserves the right to 24-6(h): The Applicant shall identify access corridors for wildlife to navigate through the Solar Facility. The proposed wildlife corridor shall be shown on the site plan submitted to the County. Areas between fencing shall be kept open to allow for the movement of 24-6(1): The design of support buildings and related structures shall use: materials, colors, textures, screening and landscaping that will blend the facilities to the natural setting and 24-6(): The owner or operator shall maintain the solar facility in good condition. Such maintenance shall include, but not be limited to, painting, structural integrity of the equipment and structures, as applicable, and maintenance oft the buffer areas and landscaping, Site access shall be maintained to a level acceptable to the County.
