Please review the enclosed message The Council has a current vacancy on the Planning Commission that needs your attention. d. Ihave enclosed a suggested schedule for your meetings for 2016. This should have been done at your. January meeting but loverlooked it. Asy you will see, the schedule keeps the meetings on the fourth Monday night of each month as they have been for some time. The only holiday conflict is in December as the fourth Monday is the 26"h that is a work holiday. Therefore, Ihave scheduled your December meeting for the 3" Monday, the 19th. However, The probability is that it will closely resemble the layout of the open-air market held at Harborfest 2010 and 2011. See attached sheet. The parking lot would be closed for parking late Friday night to prevent cars from remaining there overnight and impeding market set-up the following morning. The market manager would be on site by 7AM Saturday morning to facilitate a smooth set- up. After off-loading their wares, vendors would be instructed to park at the east end of the Queen Street parking lot so as to keep the area of the lot near the market clear for market patrons to use. The proposed hours would be 8 or 9AM until 1 or2 2PM. Regular traffic flow on Ames Street and Market Street should not be impacted by the market any more than it is by events at the Playhouse or the movie theater. The market will run from late May or early, June through October (depending on weather and crops). There will probably also be two holiday markets..one each before Thanksgiving and Christmas. As the market grows and enjoys continued success, the board of directors may explore the possibility of using profits to provide restroom facilities and an area of a permanent roof/ stall structure. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Inoperable motor vehicle, trailer or semi-trailer-means: any motor vehicle, trailer or semi-trailer which is not in operating condition; or which for aperiod of sixty (60) days or longer has been partially or totally disassembled by the removal oft tires and wheels, the engine, ifapplicable, or other essential parts required for operation oft the vehicle; or, ifapplicable, on which there are displayed neither valid license plates nor a valid inspection sticker. Motor vehicle means: every vehicle as defined in $ 46.2-100 of the Code of Virginia, which is self-propelled or designed for self-propulsion except as otherwise provided in Title 46.2. Any structure designed, used or maintained primarily to be loaded on or affixed to a motor vehicle to provide a mobile dwelling, sleeping place, office, or commercial space, shall be considered aj part ofa motor vehicle. For the purposes of this article any device defined under $ 46.2-100 as al bicycle or a moped shall be deemed not to be a motor vehicle. any person, firm, partnership, association, corporation, company or entity of any kind, and being the owner, tenant, lessee or otherwise in possession or control of any private or Person means: public real property. Private real property means: any area which is not owned by the federal, state or local government or any instrumentality, agency or political subdivision thereof. Property of another means: vehicle is located on. Shielded or screened means: any property not under the direct control oft the vehicles owner or the property that the completely precluding visibility from property of another, oft the subject motor vehicle, trailer, or semi-trailer, from view by a solid, rigid, opaque fence or by a landscaped arrangement of no deciduous plantings, sufficient in height, spacing, density and circumference. Non-rigid covers specifically manufactured and designed for use on a particular make and model ofai motor vehicle, trailer or semi-trailer are permitted for use asascreen. Such fitted covers shall be in non-deteriorated or otherwise acceptable state. Draped tarpaulins, or other non-fitted, non-rigid type covers are specifically prohibited as 2 *State law reference--Authority oft town to restrict keeping ofi inoperable motor vehicles, etc., Methods ofscreening inoperable vehicles. All fencing shall comply with current town zoning. on residential or commercial property, Code ofVirginia, $ 15.2-904. Semi-trailer means: every vehicle of the trailer type SO designed and used in conjunction with à motor vehicle that some part ofits own weight and that ofi its own load rests on ori is carried by another vehicle. Trailer means: every vehicle without motor power designed for carrying property or passengers only on its own structure and for being drawn by a motor vehicle. This definition does not include any mobile home for which there exists a valid zoning permit. Purpose. (i)1 The purpose of this article is to prevent the accumulation ofinoperable motor vehicles or parts thereof, in unapproved and inappropriate locations throughout the incorporated territory oft the town, inasmuch as they constitute an unsightly, obnoxious and unsanitary condition within such territory. The presence of such inoperable motor vehicles increases the danger of the spread of certain communicable diseases by providing a breeding place for rats, mice and other known disease carriers and otherwise constitutes a condition detrimental to the mental and general well-being oft the town citizens and is declared aj public nuisance. (ii) Itis, therefore, determined and council sO finds, that iti is imperative for the preservation of health, safety, peace and the general public welfare that these provisions concerning inoperable motor vehicles be adopted requiring property owners, tenants, lessees or persons otherwise in control or possession of real estate to remove such inoperable motor vehicles from their premises. Restrictions; exemptions; removal and cost. (i)It shall be unlawful for any person, except as expressly provided herein, to keep on any real property within the town zoned for residential, commercial or agricultural purposes, any inoperable motor vehicle. Aj person may keep any number ofi inoperable motor vehicles within a fully enclosed building or structure, or may keep up to a maximum oftwo (2) motor vehicles outside a fully enclosed building or structure, but which are shielded or screened (ii)The keeping and/or use of inoperable trailers or semi-trailers shall be regulated by applicable provisions of the town zoning provisions and inoperable trailers or semi-trailers (ii)Any such person shall have ten (10) days to remove any such inoperable motor vehicle from view as provided for herein. are not regulated hereunder. after it becomes inoperable as provided for herein. 3 (iv)This article VII shall not apply to a lawfully licensed and zoned business which is regularly engaged in business as an automotive dealer,salvage dealer,scrap processor, (v)The owner of any such real property on which any such inoperable motor vehicle is located contrary to the provisions oft this article, shall be notified ofs such violation by registered or certified mail, return receipt requested, mailed to the last known address ofs such owner as shown on the current real estate tax books oft the town. If, after fifteen (15) days from the date ofa actual receipt ofs such notice by the owner of said real property, or twenty (20) days after the date ofmailing, whichever shall first occur, the owner ofs such real property has failed to remove said inoperable motor vehicle, the town, acting through its agents or employees, may enter onto such real property and remove such inoperable motor (vi)After removal of any such inoperable motor vehicle pursuant to subsection (v) hereof, the town through its agents or employees may dispose of such inoperable motor vehicle, after giving ai further notice as provided in subsection (v) hereof to the owner of such inoperable motor vehicle, and the failure of the owner to pay all costs attributable to such removal within five (5) days of the completion of such notice. Ifthe owner oft the inoperable motor vehicle cannot be determined byi investigation through the State Department of Motor Vehicles or the comparable state agency in which said inoperable motor vehicle is registered, or such cannot be reasonably ascertained from the inoperable motor vehicle, or from the owner ofs said property from which it was removed, no such additional notice to the owner of (vii)The cost of any such removal and disposal shall be chargeable to the owner oft thereal property from which removed, and/or the owner oft the inoperable motor vehicle, and may be collected by the town as taxes and levies are collected. Any amount which may be realized by the town from the sale ofa any such inoperable motor vehicle shall be applied to such costs. (viii)Every cost authorized by this section with which the owner of the premises from which ani inoperable motor vehicle is removed shall be assessed, shall constitute a lien against the property from which the inoperable motor vehicle was removed, such lien to continue until or commercial garage. vehicle and dispose of same as hereinafter provided. the inoperable motor vehicle shall be required. actual payment ofs such costs have been made to the town. Whitley, Interim Town manager Subject FY: 2015 Audit and 1st Half Fiscal 2016 Financial Report Date: February 15, 2016 Ladies and gentlemen, Iwanted to give some additional information concerning the 2015 Fiscal Year Financial Report and the 1st half of the current fiscal year, through December 2015. Fiscal Year 2015 Concerning the last fiscal year that ended on. June 30"h, the town ended the year with an undesignated fund balance of $347,797. This means that the town increased its fund balance by $117,282 last year. This is a positive accomplishment. General property tax estimates for the year were on target. Local sales tax revenues were estimated to be $82,000 when the budget was prepared and the actual number ended at $66,873 sO you did not meet that goal. We are monitoring the current year's local sales tax figures and it looks like we will need to decrease this budget estimate next year. The only other revenue figure of concern was the amount estimated to be generated from boat dockage and ramp fees. The budget estimate was $57,800 and the actual revenue for the year was $37,444. Again, this number will have to be watched in On the expenditure side oft the budget, the actual numbers followed the budget estimates very closely. You and Mr. Lawton should be commended for running the town as efficiently as has been done. The only item of concern is that the Town General Fund had to support the water and sewer fund at al level of $106,671 last year. Not an ideal situation, but not surprising considering the relative small number of customers you have using town utilities and the major the current budget as well as the FY: 2017 Budget. investment recently made with the sewage treatment plant. First Half- Fiscal Year 2016 Ihave enclosed a report indicating revenues and expenditures through the first half of the current fiscal year.Iwill review this with you at your February meeting, but wanted to tell you that the budget is on target as far as revenues and expenditures thus far. As you know, you collect real property and personal property taxes in December sO these numbers listed are basically what we will receive for this fiscal year. Other revenues come in on a monthly or quarterly basis, sO those are a little more difficult to estimate for the current year. Isee nothing in the first half of revenue collections that gives me concern. On the expenditure side, you will seei in the line items that most are listing expenses of around 50% oft the yearly figure. Obviously, this is where we should be at this point ini the year. Again, I In closing, let me sayt that I have heard several times since Ihave been here that the town is in bad financial condition. Certainly, the water and sewer fund is not supporting itself at this point but, as Ihave said, it is moving in the right direction. Additionally, the fact that you added $117,282 to your General Fund Operating Reserve is an accomplishment. There are some items that need attention such as the need for a funded long term capital improvements program to budget for and fund major expenditures. Consideration and Approval of Minutes from the Regular Meeting on November 23"2015: Mayor Jones asked if there were any corrections, changes or additions to the minutes as submitted. With none, Councilmember Bundick made a motion to approve the minutes as submitted. Councilmember Fosque seconded the motion. The motion passed by unanimous voice vote. Public Business: a. Public Hearing: Mayor Jones opened the public hearing on the special use application submitted by Mr. Gary Cochran and Mrs. Charlotte Heath for the purposes of opening a bed and breakfast Mr. Whitley explained that the applicants are requesting approval to utilize two of their spare bedrooms at their home location for the purposes of operating a bed and breakfast. This use has already been approved by Accomack County's Building Code Enforcement Department as well as the health department. Mr. Whitley shared that this is a permitted special use for the Town's R1A Zone. Mr. Whitley continued on to say that based on the information submitted by the applicants he recommends to Council that they approve their request with the following conditions: there shall be a minimum of two off street parking spaces provided for the two rooms to be used for this purpose; no meals will be served at this location; and, the special use permit is not transferrable if the ownership of the property changes. Mr. Whitley shared that the town recently received 14 letters supporting the applicants' request. Previously, the town at their home, located at 43 King Street. receipted three letters of dissent. Mayor Jones asked if Council had any comments or concerns about this application. There were Mr. Cochran, applicant, asked to speak on behalf of his application. Mr. Cochrana apologized for operating previously without the proper permit in place but asked for Council to approve their none. request for the special use permit. 1 Councilmember Byrd asked if the onsite parking would be in the driveway. Mr. Cochran confirmed that it would be and that if necessary he would erect the appropriate signage Mrs. Colleen Killeen, Onancock property owner, spoke in favor of the application and asked Mr. Haydon Rochester, King Street, stated that his initial dissent was due to the lack of zoning oversight in the town at that time. Mr. Rochester shared that he no longer has an objection to Mr. Rick Turner, Onancock Street, asked that council look into making it a requirement that the Mrs. Janet Fosque, Market Street, urged council to think about the future consequences of approving this request. Mrs. James stressed that town committees have a hard enough time getting members to show up and do the work, concerned that limiting those who can participate may Councilmember Krause shared that they have had a difficult time with defining who a voting member can be. Itis an idea that has been evolving over the course of these conversations. Councilmember Krause also stressed that these guidelines are not meant to exclude interested parties from participating. Mrs. Fosque continued on to share that this year's plan for Christmas Decorations are as follows; two more skylines, perimeter lighting downtown, ten more banners, lighted sculptures and additional lighting at the gazebo. The Committee will present their proposed budget to the town in March. Mrs. Fosque shared that with the donations receipted by the committee for decorations they were able to stay on track with the budget. Mavor'sReport: Mayor Jones shared that he did not have at formal report for tonight's meeting. Mayor Jones shared that Mr. Lawton's family has moved into the Runninger's old house on King Street. He continued on to say that it is uncertain at this time whether or not Mr. Lawton would be able to return to work but that council would keep everyone informed as developments come to light. 4 Town Manager's Report: Mr. Bill Whitley shared that Eric Williams, Onancock Police Chief, will present his proposal on updating the town's parking regulations int the February Town Council meeting. The gazebo roof repairs have not yet started. Councilmember Byrd shared that the work should begin in a few days. Mr. Whitely also shared that the Onancock Business Civic Association is Mr. Whitley announced that the Town of Onancock will be holding a Town Hall meeting on February 8",2016 at 7:00 PM to discuss the Old Onancock HighSchool. This is not an official meeting but all Mr. Whitely explained that there are some options available to the town for delinquent tax collections. Most of these items are guided by State Code. Mr. Whitley plans on bringing some Mr. Whitley asked Town Council to be thinking about when they may want to hold budget work Mr. Whitley shared that Riverside Shore Memorial has made the connection to the town's water supply and that they anticipate beginning to use the service as early as mid-February. Mr. Whitley also shared that Mayor. Jones has asked him to look into the frequency of the utility bills, possibly moving for quarterly billing to every other month billing. Mr. Whitley said that there would be additional costs associated with that change and that he will put together a cost-benefit Mr. Whitley shared that brush and limb pick-up is becoming problematic for the town. The town is running out of places to dispose of the debris. The town will need to come up with an alternative Mr. Whitley shared that the town's Audit Report was in and that the town's fund balance over the previous fiscal year shows an increase of $117,000. The report's management letter had no items that needed to be addressed and that the town is making significant progress on paying back its long-term debt service. All these items are good news for the town.
