ORDINANCE NO. 2024-104 AN ORDINANCE OF THE CITY COUNCIL FOR THE CITY OF GRAND SALINE, TEXAS AMENDING SECTIONS FROM ARTICLE 1.03 (BOARDS, COMMISSIONS AND COMMITTEES; DIVISION II PLANNING. AND ZONING COMMISSION)OF THE CITY OF GRAND SALINE'S CODE OF ORDINANCES; PROVIDINGA SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; AND PROVIDING WHEREAS, the City Council for the City of Grand Saline, Texas has established a Planning and Zoning Commission to perform all powers and duties as allowed by State law and City Ordinance: relative to zoning and land use within the city limits of Grand WHEREAS, the City Council has passed and approved regulations concerning the composition and membership oft the Planning and Zoning Commission, as well as procedures for conducting Commission meetings and have codified said regulations in Article 1.03 (Boards, Commissions and Committees; Division II Planning and Zoning WHEREAS, the City Council finds that Amendments to various sections oft the above referenced. AMENDMENT A) Section 1.03.032 (Membership; Appointment of Members) is hereby amended as follows: The Planning and Zoning Commission shall be composed of seven (7) qualified electors of the City that reside within the City's corporate limits. The City Council will consider for appointment to the Commission only those persons who have demonstrated their civic interest, general knowledge oft the community, independent judgement, interest in planning and zoning, and availability to prepare for and attend meetings. Iti is the intent ofthe City Council that members shall, by reason of diversity of theiri individual occupations, constitute a Commission which is broadly representative oft the community. City Council members shall be prohibited from serving on the Planning and Zoning Commission. ORDINANCE Page 1 B.) Section 1.03.034 (Organization) is hereby amended as follows: The Commission shall hold an Organizational Meeting in January of each year and shall elect a Chairman and Vice Chairman from among its members before proceeding to any other matters of business. The Commission shall elect a Secretary and such other officers as it deems necessary either from its membership or from staff representatives assigned by the Chief Executive oft the City to work with the Commission. The Commission shall meet regularly and shall designate the time and place ofits meetings. The Commission shall adopt its own rules of procedure and keep a record ofi its proceedings consistent with the provisions oft this division and the requirements oflaw. Meetings of the Commission shall comply with the Texas Open Meetings Act in all respects. II. SEVERABILITY Should any clause, phrase, sentence or section oft this Ordinance be deemed invalid or unconstitutional by a court of competent jurisdiction, said finding shall not affect the remaining clauses, phrases, sentences or sections oft this Ordinance. III. REPEALER Any ordinance, resolution, and/or other policy ofthe City ofGrand Saline that isi in conflict with any provisions ofthis ordinance are hereby repealed to the extent of said conflict. IV. EFFECTIVE DATE This Ordinance shall become effective immediately upon its passage and approval by the City Council of Grand Saline, Texas. PASSED. ANDAPPROVED this 19 day of March 2024.
