PRELIMINARY MATTERS Mayor Pro-Tempore Mike Henry called the meeting to order at 6:00 p.m. Council members Coleman Strickland, Terry, Williams, Ted Wagner; Mike Henry and Lance Hudson were in attendance. City staff members in attendance were City Manager, Ben White, City Secretary, Tabatha Monk; Finance Director, Daphne Hamlin, Economic Development Director, Rodney Williams; Police Chief, Marsha Phillips; Fire Chief Greg Massey (as well as members of the Farmersville FD), Warrant Officer, Rick Ranspot, Code Enforcement, Tiffany Barber and City Prayer was led by Code Enforcement, Tiffany Barber and the pledges to the United States and Texas flags were led by Mayor Pro-Tempore Henry. Oath to Office was performed for Councimember Place 4, Mike Henry. Oath to Office was performed for Mayor, Craig Overstreet. Mayor Overstreet announced a calendar update for a special meeting of the Attorney, Alan Lathrom. Parks and Recreation Board on May 30, 2024. II. PUBLIC COMMENT ON AGENDA ITEMS (FOR NON-PUBLIC HEARING AGENDAI No one spoke under this item. HI. CITIZEN COMMENTS ON MATTERS NOT ON AGENDA Randy Smith spoke regarding the safety concerns at the Heritage Museum, Pump and Dump at Lakehaven, the potential 10-million-dollar bond for streets and thanks the city for the information getting out to the public regarding open positions on the boards and commissions. City Council Minutes May 14, 2024 Chris Owens spoke regarding his property at Lakehaven and an easement Greenbrick is asking him for. He is also concerned about the the waterway Richard Hill spoke regarding the city return his land and land of others in the going through his property. ETJ that was taken from him in 2018. IV. CONSENT AGENDA Items in the Consent Agenda consist of non-controversial, or housekeeping" items required by law. Council members may request prior to a motion and vote on the Consent Agenda that one or more items be withdrawn from the Consent Agenda and considered individually. Following approval of the Consent Agenda, excepting the items requested to be removed, the City Council will consider and act on each item sO withdrawn individually. A. Councilmember Williams seconded the motion to approve the Consent Agenda. The motion was carried unanimously (5-0). V. INFORMATIONAL ITEMS These Informational Items are intended solely to keep the City Council appraised of the actions and efforts of the various boards and commissions serving the City of Farmersville. Council members who serve as a liaison to a particular board or commission may report to the City Council regarding that body's most recent and/or upcoming meetings and activities. Council members may also deliberate and/or request further information or clarification regarding any one or more of the items contained in this provision. City Council approval of, or action on, these items is not required or requested. No action shall be taken on any discussion under this Agenda Heading. City Amenities Board Possible Council Liaison Report: Councilmember Wagner advised they discussed some maintenance issues regarding the siding at the library. Mr Sulivan, before he left, was leading that project sO they will be deciding who Possible Council Liaison Report: Councilmember Henry advised there was a meeting last night and a representative from the Little League and from the Parks board where there to discuss Spain Complex. There is some work going on there to figure out how to raise the infield ballfields sO they will drain and not hold water. Hopefully the end result is that will be able to be done sO when September rolls around those fields will be ready for the Little League. Then they had an update from City Manager, White on the Onion Shed and will take that over and get bids for that.) B. Farmersville Community Development Board (Type B) Chaparral Trail improvements.) C. FEDC Farmersville Economic Development Board (Type A) Councilmember Williams advised no report.) D. Parks & Recreation Board Possible Council Liaison Report: (Councilmember Strickland advised they met on May 2nd and received an updated draft copy on the Onion Shed monument sign. Talked about some of the improvements on the Onion Shed and are still expecting no later than June 1st for the Onion Shed completion. On JW Spain complex, Mr. Wood walked through a brief history on that and there was discussion around some funding opportunities going into FY25 to look at some of the priority improvements on that facility. There was also discussion about Trail Day and Arbor Day cancellation last month to reschedule that to a smaller event on June 1st, more to follow with that. Then finally, the consultant from Kimly-Horn is putting together the Capital Plan for Parks and has a public hearing scheduled for May 30th @ 6:00 p.m. in the Possible Council Liaison Report: Councimember Hudson advised they Possible Council Liaison Report: (Councilmember Strickland advised there City Hall Council Chamber, this room.) "Consider, discuss and act upon Ordinance, 0-2024-0514-001, amending the Fiscal Year 2023-2024 Budget for items in the Farmersville Fire Department. (Items: Ladder truck repair, Engine truck repair, Station Alerting System upgrade, Radio Maintenance/Upgrade, Radio Batteries, Radio Bank Charger, Part-Time Fire Fighter Personnel.y" City Council Minutes May 14, 2024 Chief Massey came forward and updated the Council regarding this item. Mayor Overstreet asked Chief Massey for the total cost of all the needs in Chief Massey stated the total requested for all the items is $132,421.90. Councilmember Henry asked staff where the monies are coming from. Finance Director, Daphne Hamlin, advised it is coming from permit sales and Councilmember Strickland verified with Chief Massey that on his fire report itshows just under $3,000.00 on overtime for March and April and that we Chief Massey advised that with the current number they have ($25,000) that gives him the ability up through budget year (October 1s1), to have 2 extra Councilmember: Wagner asked what the time frame is for acting on Mr. White advised after this vote they would be available immediately and Mayor Overstreet advised that he wanted to recognize the many volunteers and fire department personnel that are here tonight, thank you. These are needs and not wants and they realize that and thank you again for being Councilmember: Henry asked how long it would take to get the radios, Chief Massey advised that as soon as he gives word on the financing, they which is he asking. sales tax. could expect that amount to increase. people per day (24 hour) coverage. providing these funds. the repairs are taking place immediately. here tonight. batteries, and charger in? will be ready to be sent. "Public Hearing to consider, discuss and act upon a request from Kashif Riaz, owner of Nomad Build Two LLC, for variances from the following provisions of the Subdivision Ordinance to allow the Site Plan and Preliminary Plat for the King Ridge Project located at 303 Raymond Street that expired because a final plat has not been timely submitted, to be reinstated and remain in effect through Section 65-9(c) of the Farmersville Code that requires an applicant to submit avariance request before or contemporaneously with the submission of a plat; Section 65-27(b) oft the Farmersville Code that requires an applicant to submit a final plat within six months after the preliminary plat is approved or deemed January 31, 2026, without any further action." approved; City Council Minutes May 14, 2024 Sections 65-27(b) and 65-27(f) of the Farmersville Code that require an applicant to request an extension of time for filing a final plat before the Section 65-27(b) oft the Farmersville Code that requires an applicant to request the first filing of an extension of time for up to 90 days from the City Manager Sections 65-27(b) and 65-27(f) of the Farmersville Code that require an applicant to submit a new concept plan and preliminary plat for Planning and Zoning Commission and/or City Council approval following the procedures and regulations then in effect to replace the preliminary plat that was allowed to Grant an extension of time to allow the Site Plan and Preliminary Plat for the King Ridge Project located at 303 Raymond Street to remain in effect until the earlier of January 31, 2026, or the Applicant's submission of a final plat that preliminary plat has expired; expire; and conforms in all things to the preliminary plat, as approved. Mayor Overstreet opened the public hearing at 6:42 p.m. Kashif Riaz, owner of the project came forward to speak in favor of this request and shared a milestones paper with the Council. Mayor Overstreet for clarification and confirmation from the City Attorney did advise that a preliminary plan and site plan are good for 6 months, sO this one did expire in January 2024. The Mr. Lathrom updated the Council on the background for this Mayor Overstreet asked if there was anyone present who would wish to speak against the public hearing. Mayor Overstreet closed the public hearing at 6:50 p.m. Councilmember Henry advised the time frames are clear when the approvals are and when they expire. There is an opportunity int the ordinance to have that extended if he had gotten an extension from the City Manager, that procedure wasn't followed. Now he is asking the Council to extend this an additional 18 months when nothing has been put forward for at final plat yet sO at this point in time Councilmember Henry is Councilmember Henry advised he and another Councimember on the Council have been in this business and know how long things take however, most of what Mr. Riaz has discussed could have been done simultaneously. Councilmember Henry made a motion to deny this request. Councilmember Wagner seconded the motion to deny. Councilmember Williams made a motion to reappoint Mike Henry as Mayor Councilmember Strickland seconded the motion to reappoint Mike Henry. Pro-Tempore. The motion was carried unanimously (5-0). B. "Consider, discuss and act upon appointing a new Deputy Mayor Pro- Councilmember Henry made a motion to reappoint Terry Williams as Councilmember Strickland seconded the motion to reappoint Terry Tempore." "Update, consider, discuss and act upon a FaciiuesDevelopment Agreement Mayor Overstreet advised this item will be tabled as new information was just given to the Council at the beginning of this meeting, therefore, the Council has not had time to review this information. This item will be placed between Block 20 Apartments and the City of Farmersville." on the next City Council agenda. Councilmember Henry made a motion to table this item. "Consider and discuss matters incident and related to approving and authorizing publication and posting of notice of intention to issue certificates of obligation and declaring expectation to reimburse expenditures with proceeds of future debt, including the adoption of a resolution, R-2024-0514-002), pertaining Steven Murray, with Hilltop Securities, spoke to the Council regarding this Mr. Murray explained this agenda item and also stated this resolution is to approve for notice to be posted and start the notice process. The amount requested for this project is $5,000,000.00 (five-million dollars). Mr. White advised this for most immediately, Hamilton Street, this is in3 different phases on the TIRZ project list. The other streets included on the priority list are Orange Street, Rike Steet, Bean Street, the completion of Farmersville Parkway, Raymond Street and Water Street. Mr. White advised thereto." item. He advised that the TIRZ board will be meeting later this month and will address the matter then but because of all the paperwork that's involved and time deadlines, we want to get started with the initial road improvement project and this is the $5000,000.00 (five-million dollars) you see before you in this resolution. Councilmember Henry confirmed that this project would take approximately Mr. Murray confirmed this has an August 20, 2024, delivery date. "Update and discussion regarding an Equipment Grant presented to the Farmersville Fire Department in the amount of $31,480.00 received from Firehouse Chief Massey updated the Council regarding this grant. Chief Massey also gave special recognition to Farmersville Fire Fighter Penny Phillips for her Mayor Overstreet also wanted to recognize Fire House Subs., he stated they established this 501C3 in 2005 and have served many fire departments in the North Texas Region. The Mayor also encouraged everyone to provide them with our business and thank them for what they have done for our City. F. "Consider, discuss and act upon Resolution R-2024-0514-003, designating Subs Public Safety Foundation." hard work in securing this grant. Ms. Hamlin advised this work session will be held at Collin College held Wednesday, June 12, 2024." Farmersville Campus from 8:00 a.m. to 1:30 p.m. City Council Minutes May 14, 2024 Councimember Henry asked if there would be a 2nd work session and when Ms. Hamlin advised there will be a second one most likely in July and she needs the budget finished by August as it will need to be presented at the first Council meeting in September sO it can be filed with Collin County by the budget needed to be finished. "Consider and discuss appointments to various City of Farmersville Boards Mayor Overstreet opened this item and gave information on where to find the applications and encouraged citizens to get involved in the process.
