There are three public hearings scheduled at 7:00 p.m. Information for all public hearings is located in your binder behind the corresponding tab. Richmond County is fortunate to have employees in place who truly care about the County and each other. In an effort to encourage high performance, increase employee engagement and retain top talent, a Department Recognition Program is in place. During the month of. June, Information Technology will be our! highlight. Mr. Chris. Jett and Mr. Richard English have been invited tot the meeting toi receive ourt thanks and appreciation. AGENDA ITEMS Davenport & Company - FY25 Revenue Anticipation Note Results Representatives from Davenport and Company and Sands Anderson will be present at the June 13+hmeeting to present results received from four banks on the FY25 revenue anticipation note. Due to the budget decisions made in prior years and the amount of reserve funds that have been accumulated, this loan is not as necessary as in the past, but provides the County a "security blanket" especially during the months wherein taxes are awaiting collection. Amounts considered this year for the note will be $1,000,000 or $2,000,000 with maturity ofeither a 61 month period or a 12 month period. The FY24 RAN will be paid at the end of June and this loan will be scheduled for a closing at the beginning of July. A copy of the presentation (including comparisons) and the proposed resolution are included in your packet. Middle Peninsula Northern Neck Community Services Board Ms. Linda Hodges willl bej present to introduce thei new Executive Director oft the Middle. Peninsula Northern Neck Community Services Board. Mothershead Election District5 County Administrator FY25 Budget Discussion Resolutions for adoption of the FY25 Budget will include the Tax Resolution and Budget Resolution. In addition, Conflicts ofI Interest forms will be completed as necessary for all Board members. Internship Agreements Richmond County will bej participating in the Virginia Cyber Navigator Program again this year. The goal oft the Program and internship is to provide students with opportunities to expand their education with real world training that connects local election security with professional development. Agreements have been entered into with the Electoral Board and the colleges from which the students attend. Specific projects will be assigned to the interns that will help with progress on the Local Election Security Standards checklist. The interns will be working remote under the direction of Halle Cullison and Chris Jett. ONGOING PROJECTS VDOT Recreational Trail Project ARM Group is working towards an updated preconstruction estimate to submit to VDOT for approval. Coggin Building - Renovation Final electrical touches are still being completed at the Coggin Building. An easement is included in your packet that will need to be approved to complete the installation of three phase power to the building. A copy of Virginia Code Section 15.2-1800 is also included to indicate that this easement may be completed without the typical public hearing process. EMS Station #2 Surveying and initial wetlands work are underway on the EMS Station #2 site. Included in your packet is a printout of the final footprints being considered. Once field survey and wetlands are received, ARM Group will make certain that these footprints are still feasible. Commerce Park EDA Grant to submitting the project for bids. ERP (Financial Software) Conversion switchover for accounting practices. Review of] E&S plans are still ongoing for the EDA project. These reviews will need to be complete prior Trainings with RDA have taken place over the last couple of weeks. We are still shooting for a July 1 2 Emergency Radio Infrastructure A bit ofg good news was received on the emergency radio infrastructure project. A structural analysis report was completed to determine the tower stress level. The analysis was performed in accordance with the 2021 Virginia Construction Code based upon a 3-second gust wind speed of122 mph. The structure passed the test meaning that the equipment proposed will be able to be installed without any additional reinforcements to the tower. However, the grounding determination is still outstanding. DHCD - Community Development Block Grant (Scott Town) Several meetings have taken place with the Planning District Commission to sort through the requirements for submittal to DHCD. Further information will be provided in the coming months. Section 2- Findings and Determinations The Board hereby finds and determines that (i) the County is in need of funds to meet appropriations made for the current fiscal year which begins on July 1,2 2024 in anticipation of the collection oft tax and otherrevenues during thes samei fiscal year, to bej paid for by such revenues and the principal amount of the Note to be paid for by such revenues is less than the anticipated revenues for such fiscal year (ii) the obtaining of such funds will be for the welfare of citizens of the County for purposes which will serve the County and its citizens, (ii) the most effective and efficient manner in which to provide such funds to the County is by a revenue anticipation note issued by the County to be sold to the Noteholder and (iv) the issuance of the Note is in the best interests oft the County and its citizens. 3 Section 3- Authorization, Form and Details of the Note There is hereby authorized to be issued a revenue anticipation note of the County in the aggregate principal amount of up to $2,000,000. The Note authorized herein shall be designated "Revenue Anticipation Note, Series 2024," shall be issuable as a fully registered note, without coupons, in demominationsofs5,000 orany wholei multiple thereof, shall be dated the Closing Date, shall be numbered R-1 upwards, shall bear interest payable on each Interest Payment Date and on the Maturity Date at a rate per annum not to exceed 4.63% and the Note shall mature on the Maturityl Date. Thel Notei may be prepaid, without penalty, in whole at any time and prepayable in part on an Interest Payment Date, upon 10 days' notice to the Noteholder. The Note is hereby authorized to bei issued under Section 15.2-2629 oft the. Act. The Note shall bear interest fromi the date on which it is authenticated. Section 11- Event of Default Each of the following shall constitute an event of default hereunder: (a) The failure to pay the principal of, and premium, if any, on, thel Note when due; (b) Failure to pay interest on the Note when due; (c) Failure ofthe County toj perform any other covenant or agreement contained in this Resolution, which failure shall have continued for 60 days after the notice thereof from the Holders of not less than twentypercent (20%) oft the Note Outstanding; provided, however, that if any such failure shall be such that it cannot be cured or corrected within a 60-day period but is, in fact, susceptible of cure or correction, it shall not constitute an Event of Default if curative or corrective action is instituted within said period and diligently pursued until the failure of performance is cured or corrected; (d) The instituting of any proceeding with the consent of the County for the purpose of effecting composition between the County and its creditors or for the purpose of adjusting the claims of creditors pursuant to any federal or state statute; or (e) If the County for any reason shall be rendered incapable of fulfilling its Upon the occurrence of an) Event ofDefault, thel Holders ofnot less than twenty-five percent (25%) in principal amount of the Note then Outstanding may declare the principal of all oft the Outstanding Note: and all accrued and unpaid interest thereon to be due and payable immediately. Section 15- NoArbitrage Covenant and Covenant as to the Code The County hereby covenants that it will not use or invest, or permit the use or investment 13 of any proceeds of the Note, in a manner that would cause the Note tol be subjected to treatment under Section 148 oft the Code and theregulations: adopted thereunder: as an* "arbitrage bond,"and to that end the County shall comply with applicable regulations adopted unders said Section 148 of the Code. The County covenants to comply with the Code provisions requiring that any issuance of "governmental bonds," as defined therein, bes subject to certain requirements as toi rebate and timing and type of payments to be paid for from the proceeds of such Note, as well as other additional requirements. Inorderto assure compliance with such Code provisions, the County has entered: into ac Compliance Certificate, to comply with such requirements and covenants therein that it will not breach the terms thereof. CALLTO ORDER, INVOCATION, AND PLEDGE OF ALLEGIANCE Chairman Bowen called the meeting to order at 7:00 p.m., gave the invocation and Mr. Motley led in the pledge of allegiance. Mr. Bowen welcomed new: members Mr. Pierson and Mr. Moore. PUBLIC COMMENT No Public Comment. 1 APPROVALOF MINUTES-December 11h,2023 Chairman Bowen asked if there were any additions or corrections to the minutes from the December 11th 2023 meeting. Peyton Motley made a motion to approve the minutes. Cindy West seconded. the motion and they were approved unanimously. DISCUSSION OF ORDINANCE AMENDMENTS Mrs. Mothershead conducted a bit ofhousekeeping and presented al list ofr meeting dates, contacts, discussed Disclosure Forms due dates and gave al briefoyerviewofwhat the Planning Commission Mrs. Mothershead requested the Planning Commission to review the Business, General (B-1) ordinance that is currently in place. Mrs. Mothershead stated there was much concern about the tire shop located at) Red Hill. Ona a weekly basis, people would call the office and complain about the tires and how unattractive the appearance oft the business was. Mrs. Mothershead stated in our County B1 ordinance there is nothing stating the business could not be there. Mrs. Mothershead worked with the property owner and went into State and Federal business regulations, ultimately the business did not succeed and is no longer there. The Board of Supervisors has requested to review the B1 ordinance and find some language toi insert in the ordinance pertaining to businesses Mrs. Mothershead stated Virginia laws are changing for Farmers building farm structures larger than 2500 sq ft to fall under the In Lieu of Agreement for Storm water, Erosion, and Sediment duties consist of. to drive safety aspects. Mr. Mullin expressed concern for the tire shop as it still appears unattractive, as well as the logging site down Rt.3.N Mr. Mullin mentioned het took a highway visit to the local solar sites, he was impressed with the progress and thanked the Planning Commission and Mrs. Mothershead for all they do. 1 APPROVALOF MINUTES-February 51h,2024 Chairman Bowen made a couple corrections to the minutes from the February Sth 2024 meeting. ORDINANCE AMENDMENTS Mrs. Mothershead gave a briefu update on the tire removal at Red Hill. Mrs. Mothershead opened the floor for discussion for additions or adjustments to Richmond County's B-1 ordinance. Chairman Bowen suggested to add some language for business owners to: follow all state, federal, and local codes and regulations. Mr. Motley stated to word it where it has some teeth but not to Peyton Motley made a motion to set a public hearing. for an amendment to the B-1 ordinance. Mrs. Mothershead stated she currently has a special exception request for a dog grooming/boarding business. Mrs. Mothershead mentioned it would fall under the Commercial Kennel category, however the facility is holding other events within the business sO it could also be morphed in the Assembly retreat category. Mrs. Mothershead mentioned the Planning Commission would have to approve a conditional rezoning. OTHER BUSINESS No other business.
