Specifically, my opposition to amending Chapter XIV (14- 6.1, "Agricultural Overlay by District") is based on the following reasons: 1. Comprehensive Plan rationale for my opposition to amending the Zoning Ordinance in order to create an agricultural overlay district" (AOD) at Sakonnet Vineyard: (Refer to Town of Little Compton Comprehensive Plan pages 117 to 124.) Non-agricuitural commercial development on agricultural lands, located in residential districts, is inconsistent with the Comprehensive Plan's goal of "achieving a land use pattern that preserves open space, aesthetic qualities and the Town's rural heritage." Specifically, the creation of an "agricultural overlay district" at Sakonnet Vineyard for the purpose of allowing the permitting ofa a full-service bar and restaurant or any other non-agricuitural enterprise on land designated for agriculture is inconsistent with the Comprehensive Plan goals of: Retaining low density development; Being sensitive to the environment; Preserving the historical rural character of the Town; Ensuring future development will have limited impact on scenic resources and the quality of life of residents; and Conserving natural lands. Non-agricultural commercial development at Sakonnet Vineyard and on other agricultural operations and farms may enhance the Comprehensive Plan's goal of increased economic viability of working lands, but with a significant offsetting, deleterious effect on other Comprehensive Plan "Land Use" goals. (See previous bullet point.) Following a request by the Town Council, the Planning Board at its meeting on August 1 discussed the proposed amendment and voted unanimously to advise the Town Council that the proposed AOD was not consistent with the goals and objectives of the Town Comprehensive Plan. 2. Zoning Ordinance rationale for my opposition to amending the Ordinance in order to create an "agricultural overlay district" (AOD) at Sakonnet Vineyard: (Refer to the Town of Little Compton Zoning Ordinance.) Such an amendment to our Town's Zoning Ordinance would discriminate against family farmers by serving the single, special business interest of the corporate owner of Sakonnet Vineyard. As a result, family farmers, without an on-site kitchen to support an existing restaurant or café, would be placed at a competitive disadvantage. Therefore, such an amendment would be arbitrary, capricious, unreasonable and unjustified. Such an amendment to our Town's Zoning Ordinance would be a blatant circumvention of current zoning regulations and would violate the spirit of the stated purpose of our Town's Zoning Ordinance, which is to promote the "general welfare" of residents and to limit uses and intensities of use to those, which are 'appropriate to the [rural] character of the Town". Such an amendment to our Town's Zoning Ordinance would be in contradiction to the expressed opinion of the Town's Zoning Official, in which he stated a full-service bar and restaurant at Sakonnet Vineyard is not permitted in the Residential (R) zone, where the vineyard and winery are located. Such an amendment to our Town's Zoning Ordinance would disregard the long-standing opposition by Sakonnet Vineyard'sn neighbors and many other 2 Little Compton residents to the permitting of non-agricultural, commercial activities in Sakonnet Vineyard's Residential (R) zoned neighborhood and on the land, which is restricted to agricultural use only by a "deed to development rights" (conservation easement). Such special treatment, which benefits only the Vineyard, would undermine the pre-existing rights and uses of adjacent property owners. The operation of a full-service bar and restaurant well into the evening would alter the tranquil, residential nature of the area and deprive the residents of their right to peacefully enjoy their property. Such an amendment to our Town's Zoning Ordinance would create a precedent for permitting non-agricultural, commercial activities in our Town's Residential (R) zones by other commercial enterprises, who, enabled by such an amendment, would petition the Town Council for the creation of an agricultural overlay district" on their property. Such an amendment to our Town's Zoning Ordinance would, over time, have the cumulative effect of establishing multiple 'agricultural overlay districts" in residentially zoned neighborhoods across town. Such an outcome would, in effect, "gut" the concept, the reality and the protections afforded to residents under 'residential zoning" as currently contained in our Town's Zoning Ordinance. Consequently, such an amendment to our Town's Zoning Ordinance would pose the following risk for Little Compton residents living in R zones: the owner of a "farm" or other "agricultural operation" located in an R zone, who currently offers food for sale to the public from an on-premises kitchen in an existing restaurant or café, could seek permitting for a full- service bar and restaurant by petitioning the Town Council for an agricultural overlay district".Ifa approved, a full-service "Ag Bar & Grill" could open in a Little Compton residential neighborhood. And, if denied, the applicant could take the matter to Newport Superior Court seeking equal treatment, under the amended ordinance, as received by Sakonnet Vineyard. 3 Ins summary, Avote against the proposed amendment preserves the integrity of our current zoning ordinance. A vote against provides assurance to property owners, who live in residentially zoned neighborhoods (R zones), that only those commercial enterprises, which are considered "legally nonconforming" and which do not intensify those "legally nonconforming" uses, are permitted to operate in their residential neighborhoods. Ibelieve the Town Council's responsibility to residents is to uphold the laws (zoning ordinance) and to modify (amend) laws when such amendment serves the "common good".Idon't believe changing the rules (amending the zoning ordinance) to serve the non-agricuitural, commercial interests of as single corporation serves the "common good". To the contrary, most, if not all, Little Compton residents value the peace and tranquility, which typifies the cherished rural character of our town. Ifind Section 14.6.1.4 ("Permitted Uses") of the proposed AOD particularly egregious in that the proposed uses are permitted by right", which means they are administratively approved and do not require a public hearing. Resident neighbors of such a non-agricultural, commercial enterprise would be denied a voice in permitting the service of a full range of alcoholic beverages in their residential neighborhood, and silenced regarding the likely intensification of use of an existing restaurant or café as a result of an expanded menu and extended hours of operation. Finally, I question the compatibility of an AOD with the terms and conditions of the conservation deed, which the previous owners of Sakonnet Vineyard (Earl and Susan Samson) granted to the Little Compton Agricultural Conservancy Trust in exchange for the payment of $5 million taxpayer dollars. Are the terms and conditions of the Samson's "deed to development rights" subordinated by the "by right" provision of the proposed AOD or vice versa? Thank you for your consideration of my comprenensive Plan and Zoning Ordinance reasons for opposing the creation of an 'agricultural overlay district" at 4 Sakonnet Vineyard. As you know that buildingi is listed in the application that successfully listed the Little Compton Town Commons on the National Register of Historic Places. We recently received the parking lot project plans and discussed them duringt the Historical Society Board Meeting on' Wednesday, July 12 via Zoom. Town Council President Bobl Mushen attended to explain the As we shared earlier in the year, buildings listed on the National Register, in general, cannot be destroyed iff federal assistance, usually funding or licensing/permitting is involved, and we urged the Town to seek legal council andi to consult withi the Rhode Island Historical Preservation and Heritage Commission. Note that the Little Compton Common Historic District extends 150 feet to the north of the road, More importantly, even if non-federal funds were used for the project, we believe it would be inappropriate to remove the Fire Barn/Hearse House or to greatly alter the exterior oft the building because iti is al historic building that contributes to the historic landscape of the Commons and the historic character oft the larger community. The building represents an important part of thet town's history. The noise level is certainly bearable for me, under those conditions, but whenever I am outdoors, I am surprised by howl loud the noise is and how it seems to be right next door. The volume seems to vary from time to time, as does the number ofi repetitions. Icannot imagine how disruptive it must be for my close neighbors without air conditioning. Two oft them have told me that more than once they have been awakened by a very loud BOOM at 6:30 a.m. Ihave no: idea how many decibels that would be, but it seems particularly invasive and definitely before the allowed time frame quoted in the Sakonnet Times. Town Councilors are welcome to stand in my yard to make their own observations. We noted the other publicized complaints from people who live Perhaps because the sound carries on Almy Marsh it is more noticeable here, but it is an awful jarring sound that continually disturbs our peace. Because of the weather, we chose to close our windows and turn on our air conditioning but, once the weather turned and we opened them again, the sound of the cannons is simply awful . all day long, into the evening. Sitting outside, which we love to do, is unpleasant because of the jarring sound of the cannons. When the wind is light, that is when iti is most disturbing. The fact that it started before 6:30 am this morning was just awful.... we are retired and have an expectation of peace and quiet to wake when we choose, not to be woken at that very Ifevery farmer, on every field of crops in town were to set up these cannons, it would be just horrible.
