RESOLUTION NO. 2023: - 04 A RESOLUTION OF THE VILLAGE OF LAZY LAKE, BROWARD COUNTY, FLORIDA PERTAINING TO THE SUBJECT OF TAXATION; PROVIDING FINDINGS; ADOPTING THE TENTATIVE LEVYING OF AD VALOREM TAXES FOR THE VILLAGE OF LAZY LAKE, BROWARD COUNTY, FLORIDA FOR THE VILLAGE'S2023- 2024 FISCAL YEAR (I.E. WHEREAS, on July 19, 2023, the Village Council of the Village of Lazy Lake, Florida ("Village Council") approved a motion to advise the Broward County Property Appraiser of: (a) the Village'sproposed millage rate of6.5000 mils, (b) the Village's" "rolled back rate" of6 6.0576 mils, and (c) that aj public hearing will bel held by the Village Council on September 28, 2023, to consider: (i) the Village's tentative millage rate and (ii) the Village's tentative budget for the Village's next ensuing Fiscal Year (which budget commences October 1, 2023 and continues through September 30, 2024 [herein, the "2023-2024 Fiscal Year"I); and WHEREAS, the current year gross taxable value of real property within the Village ofLazy Lake for operating purposes which is not exempt from taxation has been certified by the Property Appraiser to be $10,914,177; ;and required b Section 200.065, Florida Statutes; and WHEREAS, the Village Council held aj public hearing on September 14, 2023, as WHEREAS, at the September 14, 2023 public hearing, the first substantive issue discussed was the percentage increase in millage over the rolled back rate necessary to fund thei tentativel budget, and the specific purposes for which ad valorem taxes are proposed to be increased; and WHEREAS, the Village Council has reviewed a draft tentative budget for the Village of Lazy Lake's 2023-2024 Fiscal Year, at the public hearing of September 14, 2023, and has made adjustments to the draft tentative budget as it determined necessary; and WHEREAS, the Village Council has computed a tentative millage rate which is necessary to fund the proposed draft tentative budget for the Village ofLazy Lake's 2023- Page 1of3 2024 Fiscal Year, and further, has computed the percentage by which the computed tentative millage rate exceeds the rolled back rate. NOW, THEREFOR, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF LAZYI LAKE, FLORIDA, THAT: Section 1: The foregoing recitals are approved as ifs set forth herein. Section 2: There is hereby adopted a tentative millage rate for levying, imposition and collection of ad valorem taxes necessary to fund the Village of Lazy Lake's 2023-2024 Fiscal Year Budget of 6.5000 mils. Therefore, the levying of ad valorem tentative Section 3 taxes with such tentative millage rate is hereby also approved. The tentative millage rate approved and levied in Section 2 of6.5000 mils is greater than the Village ofLazy Lake's rolled back rate of6.0576 mils by 7.30%. Section 4: The Village ofLazy Lake has no voted debt service millage. E-911 Communications System toi improve the safety of first responders and persons residing or traveling in Broward County, to eliminate or reduce call transfers that result in delayed responses, and to facilitate the migration to consolidated new technologies; and WHEREAS, in conjunction with entering into the Participation Agreement, each municipality also entered into al Regional Interlocal Agreement, which was subsequently amended by a First Amendment in 2020, to allocate responsibilities for the deployment of technical resources and responsibilities for the countywide public safety communication systems (collectively "Systems Agreements";and WHEREAS, the Second Amendment has been drafted to extend the Systems Agreements for an additional five (5) year term, with automatic five (5) year renewals under the same terms and conditions; and WHEREAS, the Village Council finds it in the best interest ofi its residents to enter into the Second Amendment. County owns and oversees the regional E-911 consolidated communications system ("System"),which providest fort the operations and technological infrastructure: tos support 911 call taking, computer-aided dispatch, and other functionality necessary for the operation of public safety answering points ("PSAPs"), as well as a countywide interoperable public safety intranet that supports closest unit response in life-threatening emergencies and regional specialty teams. B. The vast majority of municipalities within Broward County entered into the Agreement Between Broward County and the Participating Municipality for Participation in the Consolidated Regional E-911 Communications System, dated on or about September 30, 2013, which was subsequently: amended by al First Amendment (as amended prior tot the effective date of this Second Amendment, the Participation Agreement"), in order to promote the public health, safety, and general welfare by improving the safety of first responders and persons residing or traveling in Broward County, eliminating or reducing call transfers that result in delayedi responses, andf facilitating the migration to consolidated new technologies, amongother benefits. C. Inc conjunction with entering into the Participation Agreement, each municipality also entered into a Regional Interlocal Agreement, which was subsequently amended by a First Amendment (as amended priori tot the effective date of this Second Amendment, the "RILA")with County to allocate responsibilities for the deployment oft technical resources and responsibilities for the countywide public safety communication systems. County and Municipality desire to amend the Participation Agreement and the RILA (collectively, the "System Agreements") to extend the terms of the System Agreements for coterminous, consecutive periods of five (5) years. Now, therefore, for good and valuable consideration, the receipt and adequacy of which are herebyacknowledged, County and Municipality agree ast follows: 1. The above Recitals are true and correct and are incorporated herein by reference. All capitalized terms not expressly defined within this Second Amendment shall retain the meaning ascribed to such terms int the Participation Agreement or RILA, as applicable. 2. Except as modified herein, all terms and conditions of the Participation Agreement and the RILA remain in full force and effect. 3. The effective date of this Second Amendment shall be the date on which it is fully executed by County and the applicable Municipality, or September 30, 2023, whichever occurs 4. The provisions of this paragraph shall apply to both of the System Agreements, notwithstanding: anycontrary! provision ine either document. The termsofthe! System Agreements shall be coterminous and are hereby extended for a five (5) year period from October 1, 2023, through September 30, 2028, unless earlier terminated in accordance with this paragraph, and shall be automatically renewed for subsequent five (5) year terms on the same terms and conditions unless terminated in accordance with this paragraph. Any Participating Community may terminate the System Agreements upon at least 365 days' prior written notice to County; upon such notice, the Systems Agreements shall expire for that Participating Community as of the date stated in the termination notice that is at least 365 days after the date of the notice. Termination of the System Agreements by any one Participating Community will not terminate 5. The Engagement Process set forth in Exhibit Cto the RILA may itself be modified through the Engagement Process.
