RESOLUTION NO. 2022-06 WHEREAS, Verizon Wireless has requested a Special Use Permit for the construction of a new wireless telecommunication facility to be located at Veterans Blvd, Brundidge, AL to provide enhanced wireless services for Verizon Wireless, essentially within the corporate limits and police jurisdiction of the City of Brundidge, and; WHEREAS, Verizon Wireless proposes to construct a one hundred sixty-five (165) foot monopole tower inside a one hundred (100) foot by one hundred (100) foot lease area, and; WHEREAS, Verizon' Wireless will be the anchor tenant on the wireless telecommunication facility, and; WHEREAS, Section 11 of the City of Brundidge's Code states that, unless waived by the council for good cause shown, the maximum permitted total height for a telecommunication tower shall be one hundred (100) feet above pre-existing ground level, unless it can be proven that such height would prohibit or have the effect of prohibiting the provision ofs service in the intended service area, and; WHEREAS, Verizon has submitted the request for relief from the maximum permitted height requirement of the City's Wireless Telecommunication facilities Siting Ordinance. The City Council, after review and approval of the required justification provided in Verizon's application for construction, will permit a new tower located at Veterans Blvd, at the proposed height of one hundred sixty-five (165). feet, and; WHEREAS, the City Council of the City of Brundidge, hereby grants relief from Section 11 of the WHEREAS, Verizon Wireless has complied with City's Ordinance No. 2021-01 and has demonstrated the need for this wireless facility to deliver consistently reliable services in the identified WHEREAS, both the City and Verizon Wireless customers in Brundidge will benefit from THEREFORE, BE IT RESOLVED by the City Council of the City of Brundidge, AL, that Verizon Wireless is hereby granted a Special Use Permit for the construction of a wireless telecommunication facility at Veterans Blvd. Brundidge, AL. To prevent warehousing of permits or authorizations and to assure the best service to the City's residents as expeditiously as possible, the facility must be built, activated, and be providing service no later than one hundred eighty (180) days after the issuance of the Special Use Permit or other applicable authorization, subject to commonly accepted force majeure exceptions acceptable to the City.
