STATE OF ALABAMA COUNTY OF GENEVA REGULAR SESSION February 12, 2024 The Geneva County Commission met ini regular session on Monday, February 12 Chairman Seay called the meeting to order and welcomed guests present. Commissioner Brannon opened the meeting with prayer. Chairman Seay led the group in 2024, at 9:30 a.m. at the Geneva County Courthouse in Geneva, Alabama. the Pledge of Allegiance. There were no elected officials requesting to make public comment. There were no citizens requesting to make public comment. Chairman Seay called the roll, and the following members were present: Commissioners Weston Spivey, Todd Brannon, Bart Wilks, and Wade Fulford. County Attorney, Phil Eldridge; Engineer, Justin Barfield; Assistant Engineer, Mike Shirah; Sheriff, Tony Helms; EMA Director, Brian Smith; Revenue Commissioner, Mary Ann Ellison; Solid Waste Director, Dawn Smith and County Administrator, Cindy Williams was also present. January 22, 2024. Commissioner Wilks made a motion to approve the minutes of January 22, 2024. Commissioner Fulford seconded the motion. Vote was 3-0. Commissioner Spivey abstained since he was not present for the last meeting. 2. Board Appointments - Chairman Seay reminded the Commissioners to be in consideration for the appointment for the Southeast Alabama Regional Planning and The board appointment for the RC&D Board is up for reappointment. Commissioner Spivey made a motion contingent on clarification regarding our appointment, to reappoint Commissioner Brannon to the RC&D Board. Commissioner Wilks seconded the motion. 3.1 Poclimations/kesolutions - Chairman Seay explained that the. ACCA has sent a resolution in support of Amendment 1 which will be on the ballot during the 2024 Primary Election being held on March 5, 2024. The Chairman explained that this Amendment was regarding the Budget Isolation Resolution which currently states that the budget must be passed before any local laws can be passed and ifal local law is passed iti must bej passed with 3/5 ofa quorum. Locally our County ran into issues with this when we did the Amendment for the. Jail Construction project. Attorney Eldridge stated ifthis passes al local law will not require the Legislature to do al Budget Isolation Resolution if Development Board. Vote was 3-0. STATE OF ALABAMA COUNTY OF GENEVA REGULAR SESSION February 12,2024 the State Budget has not been passed. A few years ago, it was corrected but any local laws passed since then are subject to it and litigation has surrounding the definition of 3/5 ofa quorum. Commissioner Spivey made ai motion to adopt the Resolution in support of Amendment 1. Commissioner Brannon seconded the motion. Vote was 4-0. OLD BUSINESS: None STAFF REPORTS: Sheriff: SheriffHelms stated that hei is most appreciative oft the new vehicles his department has received but he still has several vehicles with mileage over 200,000 and it isa affecting his maintenance budget. One of the vehicles has a blown motor which will be expensive to replace. The Sheriff added that mileage runs up really quick when a deputy The Jail is at full staff at this time, but they have had al lot ofil illness in the staff. The Sheriff's. Association is trying to get the Legislature to raise the feed bill from $2.25 to $3.00 per day. Given the increase cost of grocery items over the past few years this has hit many Sheriffs extremely hard and left them unable to meet the current costs without supplement from the Commission. He is asking the Commissioners to contact our Representatives: and ask that they vote for the increase in the inmate feed bill and to remove the restrictions on the municipal money received for inmate housing. The Sheriff stated the department can investigate a death from opiate overdose by seizing the victim'st telephone and attempt to find the individuals dealer from those records. Currently they must have a warrant for the telephone, and they have to send it to a State agency to get the telephone records. They will have the autopsy and know the cause of death was from opiates but not have the telephone information for months which hampers the investigation. There could be an eight to ten months wait on the information. There is equipment and software which would allow the department to internally be able to get this information. The cost is estimated at $15,670.00 for the equipment and training. The Sheriff is asking to purchase this from the Opioid Recovery Fund. Attorney Eldridge will County Administrator: Administrator Williams stated that registration for the Conference in August has been opened and asked if everyone would be attending. This year you cannot make a hotel reservation until you register for the conference. Mrs. Williams also stated she had presented the Commissioners with updated financial information for FY2023 and YTD2024. Information was reviewed and discussed. County Engineer: Engineer Barfield stated that since the last meeting, the thermo striping has been completed on the three Rebuild Alabama paving projects. The raised The $100,000.00, hi-build paint striping project was completed last Friday. It will be placed on the Rebuild Alabama website as well as sent to all the pipe vendors on our list. The bid will end the beginning of April. This will be for eight sites to be replaced by the large 6-7 diameter pipes. As ai reminder the County was Mr. Barfield presented the agreement from JM Wood for the Spring auction being held March 19 -22, 2024. The agreement is for (2) 2018 Caterpillar Motor Graders and (2) 2023 Kenworth T880S Dump Trucks. The gross guaranteed amount is $635,000.00 with a6 6% commission rate. Commissioner Spivey made ai motion to approve the agreement with. JM Wood and allow Chairman Seay to sign. Commissioner Brannon seconded the The Engineer requested that a 2001 Chevrolet Blazer and a 2002 Chevrolet Tahoe be declared as surplus and sold on GovDeals. Commissioner Brannon made ai motion fora 2001 Chevrolet Blazer and a 2002 Chevrolet Tahoe be declared surplus and placed for sale on GovDeals. Commissioner Fulford seconded the motion. Vote was 4-0. At the last meeting two sets ofb bleachers were declared surplus and placed for sale on GovDeals. A starting bid of $250.00 was placed on each. There are no bids at this time. The bid ends Thursday. Commissioner Fulford asked ifthey did not sale could the Commission donate them to the school system. Mr. Barfield stated that ift that was the desire of the Commission, they should be removed from GovDeals because they will sale. Iti may be for the minimum, but they will sale. The Commission decided to leave them on GovDeals and should they not sale they will make a decision at the next meeting The developer of Southfield Estates, ai minor subdivision on County Road 60 in District 1,1 has presented the final plat and the Engineer has signed off on the plan. The backup generator is still operable, but they will be in need ofa newi main The Engineer provided the Commission with a material cost listing showing the price increases over the past several years. Since 2010 there has been a 100% increase in a load ofl RipRap, #78 patching stone has had a 50% increase, #57 stone used to rock hills has had a 55% increase and pipe cost has drastically increased with increases of150-2 200%. He presented this to show the Commission the cost of operating his department has seen drastic increases, however the revenues to support his budget has not seen the same increases. This also affects the wage rates for his department which are far below that of the surrounding counties and will not compete with the private sector. CDG sent an update Friday on the three FEMA bridge replacements. The surveyors are in Since the last meeting, the. ATRIP II awards were published. Geneva County was awarded a $2,000,000.00 grant for the Roundabout project in District 4 on Highway 52 west of Samson. The County will act as the facilitator for the grant. He is obtaining quotes for a new generator. the area working on1 the project. be required. 3 STATE OF ALABAMA COUNTY OF GENEVA REGULAR SESSION February 12, 2024 Engineer Barfield presented a listing of the legitimate and properly pulled right-of-way permits that were pulled for the broadband expansion into the rural areas of the County. Spectrum/Charter pulled permits for roughly forty-four miles. The construction contractor, which is burying fiber parallel with the road pulled forty-four miles inj permits last year and has applied for more this year. The line of communication in now open with the construction side and going well. The problem is with the residential drop side which has not been obtaining permits. They also used the wrong type of bore under the road surface. The department is aware of one place where the road was damaged in three spots and the repair cost is quoted at $20,000.00. Mr. Barfield has requested the contractor to furnish other sites that have been completed and they have yet to respond. The department has logged into 811 and pulled other areas the contractor had pulled locates for. They have spot checked these areas and found more damage. Cobb Underground is the statewide contractor for Spectrum/Charter for residential drops. Mr. Barfield has been notified by ai new contractor, Elite that they are taking over the residential drop for Spectrum/Charteri in Geneva County. The Engineer has updated the permit application which includes stating they must follow the current ALDOT standards for accommodation of utilities on highway and rights-of-way. They have adopted ALDOT guidelines for installing utilities. He has also added an additional page which includes installing around cross drains and added verbiage regarding reporting damages. Attorney Eldridge stated the only way to fully rectify the situation would be to require bonding from these companies. Commissioner Fulford made a motion to approve the amendments tot the utility permits. Commissioner Spivey seconded the motion. Vote was 4-0. The Engineer provided personnel and workload information. There have been seventy- five calls for workorders since the last Commission meeting. When someone calls in an employee is sent out to investigate the complaint and decide ifa work order needs to be opened. These calls are: not including emails, commissioner reports and school transportation calls. Currently in addition to normal workorders, there are: forty replacement cross drain projects, twelve driveway pipe installations, and all the work orders already on the books. Personnel wise in 2010 there were forty-six employees in the department including a full-time bridge crew. At that time, you had twenty-six employees dedicated to road work. Currently we have thirty-five positions with seventeen dedicated to road work. Over the course of fourteen years the department has dropped thirty percent ofits road workers. The workload has increased, and the work force has decreased. The Engineer commended the Commission on its efforts to have great benefits for the County, but the one-piece missing is the wage rates. The ACEA did a statewide salary study for all sixty-seven counties for the Road & Bridge department. Our starting pay for our main position (EOII) is $11.96 which is $2.51 below the average ofthe nine surrounding counties. Across the board we are twenty percent below the other counties. Looking at his department roster he has at least one third ofhis employees that are long term employees that will be looking to retire in the next five to seven years. Mr. Barfield is looking to the future and does not see a way that the department will be sustained in the next ten years. Sheriff Helms joined the conversation and stated the same. All the surrounding departments are starting deputies at $18.00, and his starting pay is $15.00. For Corrections Officers he starts at $12.00 and there are prisons within driving distance that start upwards of $20.00. This is becoming a very real problem that will have to be addressed with a long-term solution which is ultimately a tax. Citizens are still expecting 4 STATE OF ALABAMA COUNTY OF GENEVA REGULAR SESSION February 12, 2024 the services, but we cannot keep up with the workload with the workforce. Chairman Seay stated the Commission is aware oft the need and every time they sit down to prepare the budget, they max out on the cost-of-living raises. The Commission wants to give the employees all that they can, unfortunately itj just is not in the budget. An increase in Property Tax is one oft the only solutions and a tough issue. The Revenue Commissioner stated there are SO many exemptions and with the number of people moving into the State and our County the costs continue to increase but the revenue is not increasing due Mr. Barfield did have someone come in that has ten years of motor grader experience that is retired that he would like to pay as an independent contractor at $17.00 per hour for a three-month period to fill in for the motor grader operator on medical leave. The current contract employee rate is $15.00, but with this individual's experience he warrants: a higher rate. Commissioner Spivey made a motion to pay the individual as an independent contractor at $17.00 per hour. Commissioner Fulford seconded the motion. Vote was 4-0. Hiring this contracted individual will allow one oft the Foremen to come offa motor grader. Currently there is only one person working from Geneva to the Houston County Commissioner Fulford showed a picture of ai tree on Culpepper Road that has a telephone cable running underneath it that is basically holding the tree up. Commissioner Fulford feels it is dangerous. Quotes will be obtained for removal of the tree. County Attorney: Attorney Eldridge stated there was an individual that filed an appeal ini the Probate Court, and it was filed incorrectly. Mr. Eldridge is asking for the Commission's permission to represent another department other than the Commission, to get. Judge dismissed. Commissioner Brannon made a motion to allow Attorney Eldridge to represent the Probate Judge to have an appeal dismissed. Commissioner Spivey Commission Chairman: Chairman Seay stated there is a meeting on the Farm Center and Courthouse renovations this Thursday at the Farm Center at 10:00 am. At the last Commission meeting it was approved to add ai mini-split unit to the Flat Creek and Lytle Community Centers. The Chairman made the Commission aware that to adequately heat and cool both buildings will require two mini-splits. The cost is $4,000 Revenue Commissioner: Ms. Ellison stated her department is collecting delinquent EMA Director: Mr. Smith had previously presented the Commissioners with a draft of the Floodplain ordinance which he did not get them to approve because the State was pushing for a newer version. He is now presenting a modified version. The National Flood Insurance Program is the way the Federal government ensures individuals living in ai flood plain can obtain flood insurance. IfFEMA comes in and removes Geneva County as aj participating County there is potential, they can remove the availability ofi insurance. Ifthe mortgage company states you must have flood insurance and they do not, the mortgage company could foreclose on the property. FEMA now states you must have the Floodplain program. They are not stating you: must have a full-blown permit process for building, but you must have aj plan in place for building in flood zones. Mr. Smith stated that basically the County will have to have documentation showing the property was researched to ensure what type ofzone the property is located showing what maps were used to locate the property. He has a meeting today with the municipalities since none oft them were award oft this and this affects them as well. Attorney Eldridge asked the E911 Director how many requests for new addresses does he receive per week. Mr. Williams stated on average the past year his office receives approximately five new address requests per week. The attorney asked ift there was a way to copy the EMA Director when an address is being requested. The Engineer stated that there are only two ways to catch new building in the unincorporated areas oft the county which are driveway pipe applications and new address requests. Ifsomeone already owns the land and they already have a driveway, they could build in a flood plain and we would never know. The E911 Director added he was not certain ift the Commission was understanding Mr. Smith's speech, it is not only that an address in flood zones must be signed off on, but all addresses must be checked and documented. The Engineer asked ifit would suffice for his department to add a check box to the driveway application and the E911 department to add a check box to a new address application asking if the individual had checked with the EMA Director before considering building on the property. Commissioner Spivey made a motion to Mr. Smith presented a Motor Vehicle Operations Policy from the Safety Committee. Currently the County does not have aj policy. This policy would hopefully deter repeat offenders in motor vehicle accidents. The Commission asked that the policy be reviewed by the Personnel department and department heads before going any further. Mr. Smith also stated that the Safety Committee has asked that vaping be included in the Smoking Policy and vaping not be allowed in County facilities. Commissioner Wilks made ai motion to include no vaping in County facilities to the current Smoking Policy. Solid Waste Director: Mrs. Smith stated that the customer base has increased sO that she is asking for an additional collector position which would give the department two full time collectors per truck. Commissioner Wilks made ai motion to approve an additional collector position in the Solid Waste department. Commissioner Brannon Mrs. Smith stated she has received complaints on Derby Lane about ai resident that piles trash and debris on the right-of-way ori ini the ditch. Sometimes he burns it, sometimes it stays there for months before he does anything. Many citations have been issued to this resident to no avail. Attorney Eldridge stated iti is littering and it was ai misdemeanor and against the law. Chairman Seay asked Director Smith if she would collect all her documentation in case, she needs to present it to the Sheriff or District Attorney's Office. E-911: Mr. Williams asked Engineer Barfield about the private road subdivision on 103N. His reason for asking is that he isi issuing addresses for the subdivision. The Engineer stated there has been no new: movement on the subdivision. Attorney Eldridge stated he thought all that remained was the owner needs to sign homeowner association table the discussion and allow Attorney Eldridge to review. In 2022 there was an increase oft three hundred calls for the year. In 2023 there was an increase of 4,248 calls. These are for Police, Fire should be released within ninety days. and Emergency Services. Auburn Extension: Ms. Marks was not present. Commissioner's: Commissioner Brannon stated hel has had several calls regarding individuals purchasing small lots of property and stacking upwards oft ten trailer houses on the property. Not nice homes but run down properties. The Sheriff stated he is aware of one property that is a one-acre lot with four mobile homes and a shared septic tank. Commissioner Brannon had contacted the. ACCA legal department and they explained we do not have any ordinances which would prohibit this. He asked them to research what type ofordinances other counties have inj place. One main problem is that these individuals are. just digging holes on the property and dumping sewage in them. Itis quickly becoming aj problem because hei is aware ofs several properties at this time. Currently we do not have a way to eliminate this problem, but the problem has to be addressed. Engineer Barfield stated the answer would be planning and zoning. Most counties ift they follow the ACEA model subdivision ordinance as long as it is leased or rented: it falls out from under the subdivision guideline unless you do planning and zoning. Then it would have to be planned or zoned for a mobile home park and Commissioner Fulford asked Attorney Eldridge about a question of the Right-Of-Way on Harvest Time Road. The new property owner on the south end is asking ift there was at any time a right of way on that property. Engineer Barfield stated that road has not been county maintained since the 1990's. Attorney Eldridge stated that just before Commissioner Hammer left office the Road & Bridge department did some clearing ofa tree line and a cross drain was replaced. Even though it is not maintained is it a county right-of-way. Mr. Eldridge stated that this is aj private matter, and the individual is inquiring about an easement to his property. He will need to research the deeds. The road has been abandoned by the county for nonuse and not maintained for more than twenty years.
