STATE OF ALABAMA COUNTY OF GENEVA REGULAR SESSION April 8, 2024 The Geneva County Commission met in regular session on Monday, April 8 2024, at 9:30 a.m. at the Geneva County Courthouse in Geneva, Alabama. Chairman Seay called the meeting to order and welcomed guests present. Commissioner Brannon opened the meeting with prayer. Chairman Seay led the group in the Pledge of Allegiance. There were no elected officials requesting to make public comment. There were no citizens requesting to make public comment. Chairman Seay called the roll, and the following members were present: Commissioners Weston Spivey, Todd Brannon, Bart Wilks, and Wade Fulford. County Attorney, Phil Eldridge; Engineer, Justin Barfield; Assistant Engineer, Mike Shirah; Sheriff, Tony Helms; EMA Director, Brian Smith; Revenue Commissioner, Mary Ann Ellison; and County Administrator, Cindy Williams was also present. The following business was transacted: MINUTES OF THE MEETING NEW BUSINESS: I.A Approve Minutes of March 25, 2024. Commissioner Brannon made a motion to approve the minutes of March 25, 2024. Commissioner Wilks seconded the motion. Vote 2.1 Farm Center - Chairman Seay presented the exterior color board from JMR+H for the Farm Center. After discussion and review Commissioner Wilks made ai motion to approve the exterior color board for the Farm Center. Commissioner Brannon seconded the motion. Vote was 3-0. The Sheriff's department was contacted on March 28, 2024 that a mobile home was blocking the road. The mobile home was being moved with a vehicle and the tongue broke off the trailer. The truck and trailer were left in the road. Templar moved the trailer to the shoulder of the road. Templar seized the truck pending payment from the owners. The Sheriffhas contacted two mobile home moving STATE OF ALABAMA COUNTY OF GENEVA REGULAR SESSION April 8, 2024 companies. One responded with a ballpark cost of $5,000.00. Chairman Seay asked Attorney Eldridge about recouping any costs from the owner of the mobile home. There was not a sticker on the mobile home that would identify the true owner and the individual moving the trailer did not give a straight answer as to the owner oft the mobile home. Attorney Eldridge stated that ift the true owner could be located the County could file in small claims court or do it like an abandoned vehicle and place a hold on the truck and mobile home, which is the best option. Commissioner Brannon made a motion to allow Sheriff. Helms to obtain the lowest quote for moving the mobile home. Commissioner Spivey seconded the motion. Vote was 4-0. The Sheriffi is researching adding cameras to the max cells in the jail which will prevent a Correctional Officer from having toj physically visit the cell every fifteen minutes. There is also a device that can be installed in the ceiling which will detect changes in an inmate's vitals that will send an alarm notice. The cost on those is $5,000.00. The total cost for all the max and medical cells would be $40,000.00. Commissioner Fulford asked ift the device is in a protective casing that would prevent an inmate from destroying the device. The Sheriff stated he did not see a way they could access the device. The Sheriff also stated that two other counties had used Opioid Recovery Funds to purchase the SheriffHelms said that he iss still having issues with some oft the cameras at the Jail. Chairman Seay and Commissioner Spivey stated we should contact JMR+H and ask The report from the accident involving the. Jail Transport vehicle shows the other vehicle The department will be down two investigators. One left for a state position and the other There is a dispute on J. Saunders Road that is escalating. A homeowner has too many vehicles for his driveway and yard and is parking across the road in front of someone else's home. The homeowner parking his vehicle demands hel has a right to park on the right of way, even though he is using it for a parking spot. Commissioner Spivey asked if that stretch in front oft the homes could be designated as No Parking on the Right of Way. Attorney Eldridge stated that the County does not have ordinance powers, it would depend on what is in the statutes. Chairman Seay asked that Sheriff Helms, Engineer Barfield, and Attorney Eldridge research to see what options or solutions are available. County Administrator: Administrator Williams stated that County Risk Services adjustor has been out and deemed the vehicle totaled. The insurance company has offered $26,600.00 ift the vehicle is returned and $21,600.00 if wel keep the vehicle. The Sheriff would like to keep the vehicle to use for parts. We should be receiving a check in the next At the last meeting, the cost ofinmate medical was discussed. Mrs. Williams had calculated the saving from no longer paying medical expenses for city inmates and the County Risk Services came out last week for an annual inspection. They discussed the loss runs which are good for our County. The only issue noted from the visit was the lift at Road and Bridge does not have an inspection sticker. One utility company has returned their permit application and obtained and The cross-drain pipes for the ARPA Storm Water project have been ordered. The inspection. presented a $100,000.00 bond. department has until 2026 to get the cross drains placed. There are sixteen driveways on the books to be installed. Herbicide spraying was completed last week. The check from JM Wood auction was received. The two new dump trucks were received last week. The remaining pick-up trucks were The Engineer asked for a 2012 Chevrolet 2500 crew cab pick-up truck and a 2010 Dodge Dakota Crew Cab pick-up truck be declared as surplus and listed on GovDeals. The Engineer asked ifthe Commission was intent on having Free Day at the Landfill this year. Commissioner Spivey stated we should follow what was done last year which was only one day from 7 am to 2 pm. Mr. Barfield stated that on our end we are fine for employees the problem is ift the Solid Waste Authority has an employee to work. Commissioners Fulford and Wilks stated ifit was only one day it had to be on Saturday to assist the working public. Commissioner Wilks made ai motion to have Free Day at the Landfill April 20, 2024 from 7 am. To 2 pm. Commissioner Spivey seconded the motion. Since the last meeting, an emergency cross drain replacement was done on County Road 14. It now has a double line ofs sixty-inch pipe. That project will be completed today. The The Governor has declared the March 6, 2024 rain event as eligible for ER funds. Out of all our sites the only one eligible will be on County Road 10 and that cost approximately County Attorney: Attorney Eldridge had previously relayed that Catalis had breached the contract for the digitization of records with the Probate Office. The check from Catalis for liquidated damages ini the amount of$14,800.00 has been received. This was tol be paid with ARPA funds. Another bid must be sent out sO the funds can be committed before December 31, 2024. He has prepared an invitation to bid which will be opened at the June 10, 2024 Commission meeting. This meeting will also include how the The next State Highway 52 expansion update will be on May 2, 2024. The Courthouse and Farm Center projects came in under budget which should leave approximately $400,000.00 ARPA funds that will require expending. These funds must be obligated by December 31,2024 and expended by December 31, 2026. The Chairman stated the Sheriff and the Engineer had requested more equipment than was awarded in the original budget of ARPA funds. Demolition inside the old. Jail could be an expense The Chairman had received an email from Mr. Sonny Brasfield with ACCA: requesting Chairman Seay stated that the seal coat on the front steps oft the Courthouse is in need of replacement. The contract he received from the company last year is still good. Commissioner Spivey stated he knew a company in the county that would be interested in quoting the job. Commissioner Spivey made ai motion for the Chairman to obtain quotes and move forward with the lowest bidder to have the front steps oft the Courthouse The Chairman stated that he had requested a quote for running conduit at the Farm Center tol house wiring for internet fiber, security cameras, and a future sound system. This was not included in the quote on the Farm Center. The most cost-effective method for having internet at the Farm Center is tol have a trench dug from Road & Bridge. Currently no Revenue Commissioner: Ms. Ellison stated her department would be mailing out tax lien notices this week. The tax lien sale will be held May 14, 2024.
