They are jointly asking for an investigation into what is occurring in the Planning Department and are asking for an opportunity to speak with the Council. Public hearing opened at 6:45. Sanford School Superintendent Matt Nelson spoke in favor of the budget and presented a brief overview of the proposed budget. Ifincreases in the general aid to schools pass at the State level, Sanford schools would receive an additional $840,532.39 and that would be put towards tax relief. The referendum vote on the school budget will be Tuesday, June 8. Councilor Stackpole commented positively on the school using increase in school subsidy (pending legislative approval) from the State to help reduce property taxes and thanked Superintendent Nelson for that. The school and the city come up with limited budget SO there is no growth in the program and only one staff person. No owner has been located. 7 instances of trespassing have been reported on the property. Nearly 10 tons of household rubbish was removed from the property. Some similar trash can be seen through Carrie Folsom, attorney for the plaintiff in the foreclosure, presented. The owner is an older gentleman who was understood to have a hoarding problem, who now lives with his grown daughter in MA. It is a VA loan and because of Covid, foreclosure was not allowed. The owner moved out just before Covid. As of March 1, foreclosures could be scheduled. The only courts that have set any foreclosures are in Aroostook County. At the end of March, got a consent to action is the owner is set to sell. The bank has finally been able to proceed, get the cares act moratorium filed. Team was on the property today and the plan is to have a windows/doors. rehabilitation plan in place within 14 days. Statutory 90 day waiting period following the judgement will be up on June 5and the owner is motivated to make repairs and get the building ready to sell. Director Houseal was pleased to hear this. The Administration also lifted capacity limits for indoor public venues and physical distancing requirements, except in settings where people would be removing their face coverings. May 24, 2021. Effective May 24th, Maine will: lift all capacity limits and requirements to physically distance in all public outdoor lift all capacity limits in public indoor venues. (a) The playing field, dugouts, stands and adjacent parking lot inside the fence and (b) the related facilities and equipment, including the press box, sound systems and scoreboard known to be part of Goodall Park. The City shall be responsible for preparing the playing field for League play. "The Team" together with the City shall be responsible for clean up following the games. "The Team" shall be responsible for operation and maintenance of the field during the game, as well as pre-game activities such as batting practice and infield practice. Little League Field (so called) shall be used by "The Team" for scheduled clinic dates to be determined by The Team" in consultation with "The City". 102 Lease Agreement fort the Use of Goodall Park Page 2of5 2. TERM OF AGREEMENT: The term of this Agreement shall be for a period of three years from the date hereof. "The Team", if it desires to renew the lease, shall notify "The City" in August of the last year of this agreement and, if "The City" agrees, "The Team" will initiate discussions on the terms of the Lease. 3. FEE PAYMENT: The parties agree that the "The Team" shall pay the sum of Three Hundred dollars ($300.00) during this lease period per game, including exhibition and playoff games. These payments shall include use of the facility, including maintenance and upkeep of the field and payment for lighting and use of electricity. Said amount shall be due and payable upon receipt ofi invoice by "The City". It is further understood that there may be other financial adjustments for rainouts, double headers or playoff dates etci ifr necessary. For games with attendance over 450 in attendance, an additional $.25 (twenty-five cents) will be assessed for every patron up to 600, the assessment will be $.50 (fifty cents) per patron for attendance over 600 Onoccasion that "The Team" makes the post season playoffs, the same per game fee and attendance assessment formula will be used. 4. NUMBER OF GAMES: "The Team" plays a 40 to 42 game regular season schedule, depending on the number of teams in the league, with half of the games (20 or 21) to be played at home. On or about the 1st of November of each year, the City agrees to provide "The Team" with between 30 dates between, on or about June 6 and July 31, of the following year that would be acceptable for regular season play. "The Team" will put its schedule together during the month of December utilizing either 21 of the dates provided with the remainder being turned back into the City. Under the present format, four NECBL teams make the playoffs each season with there being the possibility of two best-of-three rounds played on a home and home basis. In the event the team referred to herein makes the playoffs, the City agrees to make its best efforts to accommodate a brief playoff schedule utilizing the same Fee Payment outlined in #3 above. The actual date and time of the games shall be scheduled with the Bureau of Recreation & Public Property. 103 Lease Agreement fort the Use of Goodall Park Page 3of5 5. MAKEUPS: Ini the event of rainouts or other postponements, the City will work with "The Team" toi find ar makeup date thati is agreeable for all parties. Should a suitable date not be found, the games shall be made up as part of a doubleheader on an already existing game date utilizing the same Fee Payment outlined in #3 above for each game. 6. CONCESSIONS: The City agrees that "The Team" may have the exclusive right to operate the concessions at thei field for all activities during the baseball season for the term of this Agreement. "The Team" shall be responsible for the purchase of any additional equipment and shall be responsible for the maintenance of all equipment for the concession and shall agree to acquire and maintain any operational license required by either the City or the State of Maine. Should "The Team" need additional equipment and/or safety equipment, then "The Team" shall be responsible for purchasing same. "The Team" will honor any product exclusivity agreements the City might enter into. 7. SIGNS AND FENCES: a. Temporary "The Team" is granted exclusive use of fences surrounding the baseball facility for the purpose of placing advertising signs. Advertising Signs may not be affixed to the grandstand building. All signs will be constructed of material that will not cause damage to the fences and shall be maintained by" The Team". The City shall review and approve all signs before they are erected. Signs that are considered to be obscene or make any reference to alcohol or tobacco products will not be allowed' "The Team" assumes the responsibility of securing the signs tot thet fences and maintenance of the signs. Installation shall be made after June 1 and removal of all signs shall be by August 31st of each year this contract is in effect. "The Team" shall be responsible for any damage to the fences used in conjunction with the placement of these signs and all funds generated from displaying of these signs shall remain the sole property of "The Team". 104 Lease Agreement fort thel Use of Goodall Park Page 4of5 b. - Permanent Informational signs (i.e. bulletin boards) may be installed by "The Team" with the design and location to be approved by "The City". 8. The City will provide internet access at no cost over SanfordNet Fiber via a Virtual Local Area Network (VLAN) to the Press Box for the purpose of "The Team" broadcasting video and sound signals or other communications associated with conduct of games. The VLAN will have bandwidth access of 100/100Mb services. The VLAN access will not be used to provide WiFi to the public or other purposes unless authorized by the "The City." 9. INDEMNIFICATION INSURANCE: "The Team" agrees to indemnify the City and to maintain insurance in the sum of One Million Dollars ($1,000,000.00) for its baseball operation in the City and to name "The City", or any other entity itso designates, as additional insured on said policy. "The Team" shall keep and hold harmless the City from and against any and all claims, demands, suits, judgments, costs and expenses asserted by any person or persons, including officers, agents or employees of "The City" or "The Team", by reason of death ori injury to persons, or loss or damage to property, resulting from "The Team's" operations hereunder or as the result of anything done or omitted by "The Team" hereunder, except to the extent that such claims, demands, suits, judgments, costs and expenses may be attributed to the negligent acts or omissions of the City, its officers, agents or employees. 10. GOVERNING LAW: This Agreement shall be construed in accordance with the laws of the State of Maine and all applicable City of Sanford ordinances and policies. 11.
