Discussion of the Forsyth County Board of Voter Registrations & Chairman Luth said this item is in reference to the Board of Voter Registrations & Elections enabling legislation that states a board member cannot qualify for an elective public office for at least six (6) months after Vice Chairman Natt stated former board member Randy Ingram had qualified in March to run for the unpaid position on the Upper Chattahoochee River Soil & Water Conservation District but his term had just ended on February 28, 2022. Mr. Ingram did withdraw his candidacy. Vice Chairman Natt said the reason behind the legislation was to keep the Board of Voter Registrations & Election from calling a special election and then one of the members running for a position in the county. Member Tucker stated there is a precedence in Georgia that someone stays in their current office while they run for another office such as Governor Kemp running for Governor while he was Secretary of State. Assistant Secretary Thalimer said Member Tucker is stating there is a conflicting application of the rule and whatever the rules are they should Attorney Jarrard stated there is a distinction between a single individual over elections as opposed to a board which is much different. He said the public policy in Georgia is people should be able to run for office. Attorney Jarrard said if this was a sole person board he could see the rationale for this rule but there is a full board and there has to be quorum. Attorney Jarrard said if the board has an interest in modifying the legislation it would have to go to the General Assembly with a resolution signed by this board asking for the legislation to be changed. He said the board would need to make a request to the Board of Commissioners for Vice Chairman Natt stated the board's legislation has only changed two times since 1987 with one change modifying the chairperson of the board's compensation and another revision changing the board's makeup from three members to five members and increasing the monthly stipend. Assistant Secretary Thalimer stated he would like the legislature to look at this legislation to keep qualified, motivated and active people involved. Chairman Luth would like the board to instruct Attorney Jarrard to work on changing this legislation as well as adding another change to the monthly Member Tucker with a second from Assistant Secretary Thalimer made a motion to request the county attorney to review the monthly stipend for board members other than the chairperson and to revise the language for Vice Chairman Natt with a second from Assistant Secretary Thalimer amended the motion to add language in the legislation that changes the start dates for the board member terms. Two parcels were approved by the City Council and became effective on September 1, 2022. Five voters are currently listed at the two affected address points (1425 & 1535 Pilgrim Road). These annexations will be brought to the BRE for their consideration in amending the Cumming-07 precinct lines after the upcoming election.
