Minutes Forsyth County Animal Control Board On Thursday, July 20, 2023, at 6:00pm at Sharon Springs Park Community Building, the Animal Control Board held a Called Meeting with the following persons present: Dr.John McGruder, Chairman; Scot Rucker, Member; and Also in attendance for Forsyth County: Haley Brown, Animal Services Supervisor; ASO Lauren Kirk; ASO Regina Christopher; Attorney Karen Kara Davenport, Clerk. There was a motion by Dr. John McGruder and a second by Scot Rucker to adopt the agenda as presented. The vote passed unanimously. There were no comments at this time. There was a motion by Scot Rucker and a second by Dr. John McGruder to adopt the minutes of the meeting from March 9, 2023 as presented. The motion passed unanimously. Dr.J John McGruder announced the case to be considered - ANMLBII-2306- 00179 - Bangalore,Sai (Daisy). Haley Brown, Animal Services Supervisor provided an overview of the case along with photos of the injuries to both the human and animal victims. She also explained that the victim in this case was unable to attend the hearing as she confused the date of the hearing with the court date on the issued citations in this case. The statement from the victim as well as a statement from a witness present at the time of the incident were presented. Haley Brown expressed that the victim could be reached via phone for her statement and questions. Dr John McGruder requested phone call. Victim is reached via phone and provided her statement on speakerphone. Dr.John McGruder asked for the weight of the animal victim in this case which was provided as 14 pounds. The Board then heard from the suspect dog owner. Owner spoke to the temperament in the past and the fact that the dog is only ever walked on a leash. Owner stated that the dog was in the care of a dogsitter at the time of this incident. The Board heard a statement from the dogsitter who was providing care at the time of the incident. He spoke to his experience, training, and a statement of the timeline of this incident. Witness stated that the gates at the dog park area were closed but that they do not function properly which is the only reason that the animal was able to get loose. Owner stated the hardship that classifiçation will present and requested that classification be dropped. Second witness for suspect animal presented statement to temperament of animal in the past when he provided care as well as experiences with dog around smaller animals and people in the past. Scot Rucker confirmed that the classification for this case is Dangerous which Haley Brown confirmed. Dr.John McGruder called for any further comments. Victim stated that there are multiple statements showing dog is frequently walked off leash and has attacked another animal in the past which was not reported. Owner stated he can provide 5 testimonies that dog is always walked ona leash and states that he is unaware of any past situation with an attack by his dog. Stated that dog is currently at a vet facility which is confirmed by Haley Brown. Witness for owner presented statement to temperament of animal in vet facility currently. Stated that he believes this incident was an isolated freak accident. Owner stated that vet facility has also sent a positive behavior report from time in the facility. Scot Rucker requested clarification on requirements for dangerous classification. Haley Brown stated that they are the same as those required for vicious classification excluding the requirements for a microchip, a muzzle when in public, and the required insurance policy. Board reviewed the witness statements as provided by the suspect dog owner. Dr.John McGruder asked for final questions/statements, there are none. After discussion, Scot Rucker moves to uphold the vicious classification which Dr.. John McGruder seconds. Motion carries to uphold the dangerous classification. Haley Brown explains the process following classification being upheld. Dr.John McGruder calls for any other questions/Comments, There was no other business to come before the Board.
