Main Street, Suite 220 Cumming, Georgia 30040 November 1, 2022 Immediately Following the Regular Meeting at 9 a.m. MINUTES Present at the meeting: Barbara Luth, Chairman Joel Natt, Vice Chairman Carla Radzikinas, Secretary Dan Thalimer, Assistant Secretary Anita Tucker, Member Mandi Smith, Director Carol Balcome, Assistant to the Director Karen Pachuta, Attorney, Jarrard & Davis Frank Schneider, Challenger . Call Meeting to Order Chairman Luth called the meeting to order at 10:39 a.m. II. Adoption of Agenda Secretary Radzikinas with a second from Vice Chairman Natt made a motion to Chairman Luth with a second from Vice Chairman Natt amended the motion to add Chairman Luth with a second from Vice Chairman Natt made a motion to adopt the adopt the agenda as prepared by staff. Hear challenges to the qualifications of voters and their eligibility to vote in the November 8, 2022 General Election pursuant to the Official Code of Georgia Annotated 21-2-230(a) - 10.27.2022 Schneider Challenge Vice Chairman Natt asked Frank Schneider to confirm he is dropping the challenge for Maureen Glaeser. Mr. Schneider affirmed he is dropping the challenge for Maureen Glaeser. The board discussed the first challenged voter Joseph Rand Kennedy. Vice Chairman Natt asked Mr. Schneider what the address is on the information provided for Joseph Kennedy. Mr. Schneider said he did not realize the address was missing from the document and it is the address on the voter rolls. Member Tucker asked Mr. Schneider the source of the document. Mr. Schneider said he pulled the information from the Forsyth County Tax Assessor's database Member Tucker asked Mr. Schneider for the reasoning of his challenge. Mr. Schneider stated per O.C.G.A. 21-2-235 an inactive voter can only be returned to active status by signing a written petition affirming the voter's valid address. Member Tucker said the application for an absentee ballot states the following: The information provided in this document is made under oath and penalty of law and will be used for official government purposes. When you sign this application you affirm that you are a citizen of the U.S., currently reside in Georgia and are eligible to vote in Georgia. Giving false information on this application violates Georgia law and is punishable by a fine up to $100,000, imprisonment for up to Member Tucker said when Mr. Kennedy signed his absentee ballot application he read that statement, was aware what he signed and is allowed to vote in Chairman Luth said an inactive voter can vote at the polls or by absentee ballot Member Tucker said in O.C.G.A. 21-2-235(c) it states an elector whose name is on the inactive list of electors may vote and it lists whether the elector has not changed residences, if the elector has moved to an address within the county in the same precinct, and if the elector has moved to an address within the county in a different precinct. It also states if an elector whose name appears on the inactive list of electors appears at the polls and votes as provided under subsection (c) of this Code section, the board of registrars shall transfer the elector's name back to the official list of electors and shall make any necessary Mr. Schneider said Section C does not allow for inactive voters to vote. Mr. Schneider said he did try to look up the voters but the states in question needed more information on the voter than he had available. Vice Chairman Natt asked Mr. Schneider if he had looked to see if the voter had property at the proposed address provided. Chairman Luth stated the next challenged voter is Katheryn Mari Wright. Vice Chairman Natt stated the ballot was mailed to the registered address.. evidence supports the reason the voter should not vote. said this was a recent request and was not on the rollover list. Vice Chairman Natt with a second from Secretary Radzikinas made a motion to dismiss from the challenge Katheryn Mari Wright because her ballot was mailed Chairman Luth stated the next challenged voter is Christopher Anthony Reid. Member Tucker asked Mr. Schneider if he knows if Mr. Reid is a student or in the military or possibly working temporarily in Maryland. Mr. Schneider said his Member Tucker with a second from Assistant Secretary Thalimer made a motion to dismiss from the challenge Christopher Anthony Reid based on insufficient evidence and the original reason for the challenge being invalid. Vice Chairman Natt asked ifi it was truly an invalid challenge. Member Tucker said there was a misinterpretation of O.C.G.A. 21-2-235(c) and we have no idea to her registered address.
