THE CITY OF CAMILLA IS A GOLF CART FRIENDLY COMMUNITY ORDINANCE NO. 2015-07-21-1 AN ORDINANCE BY THE MAYOR AND COUNCIL OF THE CITY OF CAMILLA TO PROVIDE FOR THE USE AND OPERATION OF PERSONAL TRANSPORTATION VEHICLES ON THE MUNICIPAL STREETS; TO PROVIDE FOR THE REGISTRATION OF PERSONAL TRANSPORTATION VEHICLES; TO PROVIDE FOR OPERATIONAL AND EQUIPMENT REQUIREMENIS FOR PERSONAL TRANSPORTATION VEHICLES; TO PROVIDE FOR AN EFFECTIVE DATE; AND WHEREAS, the public streets of the City of Camilla are largely designated for traffic flow at WHEREAS, the flow of such streets will not be obstructed or impeded by the use of personal WHEREAS, personal transportation vehicles may serve ai number oflegitimate needs tot thepublic WHEREAS, O.C.G.A. Sec. 10-5-1-1 Definitions. to them in this section: The following words, terms and phrases, when usedi in this article, shall have the meaningsascribed Driver means the person driving and having physical control over a Personal Transportation Personal Transportation Vehicle (PTV) means any motor vehicle: (1) with a minimum of four wheels; (2) capable of a maximum level ground speed of less than 20 miles per hour; (3) with a maximum gross vehicle unladen or empty weight of1,375 pounds; and (4) capable oftransporting Owner means the person holding title to the PTV who has a majority ownership interest in the Parking area means those areas accessible to the public by motor vehicular traffic and which are designated for the temporary parking of motor vehicles, usually in places referred to as parking Authorized street means a public roadway of the city by whatever name (e.g. road, alley, avenue, Vehicle. not more than eight persons. Sec. 10-5-2-1 Registration. Before any PTV may be operated over an authorized street or parking area of the city it shall be registered with and inspected by the Camilla Police Department. IfthePTVisc compliant withl local and State law, then a decal shall be issued from that department signifying its registration. The registration requirements include the following specifics: (1) Only those persons 18 years of age or older may register a PTV; (2) The person registering the PTV must be the Owner oft the PTV; (3) The decal received from the Camilla Police Department upon Registration shall be (4) The registration application shall be made on a form supplied by the City and shall attached and displayed upon the PTV so as to be plainly visible; contain the following information: a. Name and address ofowner. b. Model, make, name and PTV: identification number. d. Such other information as the City may require. (5) The registration application shall be accompanied by a fee of$15.00. Current driver's license number of owner and all authorized drivers. (6) The registration application shall be accompanied by evidence of personal liability insurance coverage consistent with the minimum requirements of Georgia law for (7) The registration shall be renewed annually during the month of. January. Ift the PTVis transferred to a new owner, the new owner must immediately register the PTVI before iti is operated in the City. The registration permit may be revoked if: (1) The permit holder no longer has a valid driver's license. (2) The owner or driver ofal PTV fails to abide by the rules and regulations of this article. (3) The owner or driver of a PTV fails to abide by the traffic laws in use for a PTV on an authorized street or parking area. Sec. 10-5-4-7 Transfer. Upon transfer of ownership oft the PTV to a person who intends to operate it over the authorized streets and parking areas, the new owner must register the PTV as outlined herein above. Such registration by the new owner must occur within ten (10) days oft the transfer of ownership. Sec. 10-5-5- Operation regulations. (e) Every driver ofal PTV shall be granted all the rights and shall be subject to all oft the rules (f) All PTVs are entitled to a full use of a lane on the authorized streets and parking areas of the city and no motor vehicle shall be driven in such a manner as to deprive any PTV of (g) The driver of a PTV shall not overtake and pass in the same lane occupied by the vehicle (h) No driver shall operate a PTV between lanes of traffic or between adjacent lines or rows (i) The driver ofal PTV operating on an authorized street may cross a multi-lane road only at () The driver of a PTV operating on an authorized street may cross a state or federal route only at intersections that have been designated for such purposes by the Georgia (k). Each PTV shall be equipped with each oft the following safety devices: (a) A braking system sufficient for the weight and passenger capacity oft the vehicle including (b) A reverse warning device functional at all times when the directional control is in the (c) A main power switch. When the switch is in the "off" position or the key or other device that activates the switch is removed, the motive power circuit shall be inoperative. Sec. 10-5-7-Liability. Nothing in this article shall be construed as an assumption of liability by the City of Camilla for any injuries toj persons or property which may result from the operation ofal PTV or by the failure oft the city to revoke said permit. Sec. 10-5-8 - Penalties. Any person who violates the terms of this article shall be punished as follows: In addition to whatever violations of the driver of a PTV may be subject to pursuant to Georgia law and or Code ofMunicipal Ordinances, the registered owner oft the PTV shall be subject to the (1) For the first offense a fine of not less than $50.00; and, ifr not timely paid, revocation oft the (2) For the second offense, a fine of not less than $100.00; and, ifi not timely paid, revocation (3) For the third offense, the registration for the PTV shall be revoked. In the event the registration is revoked under this section, thel PTV cannot thereafter be re-registered by the following civil penalties: permit. ofthe permit. same owner or any family member for a period oftwo years.
