Proof of Publication. Review of Process. Chair Larson opened the public hearing at 7:00 P.M. Proof of publication was entered into the record. Interim Community Development Director Ruggera reviewed the process stating the Land. Development Code (LDC), Section 2.4 states that a elecommunications facility and tower is Conditional in the Central Business District (CBD) and requires a Conditional Use permit. The LDC Section 7.2 specifies that Conditional Use applications be reviewed by the City of Gunnison Planning and Zoning Commission at a Public Hearing after 15-days public notice. The Commission may approve, approve with conditions, deny or remand the application back to the applicant with instructions for modification. The applicant is Jason Swenson with Internet Colorado - IC Connex, Jason is requesting toi install a 40-foot high elecommunications tower to replace the existing tower at 108 E. Tomichi Avenue. The legal description oft the property is Lot 12, Block 20, Original The site is at their existing facility of 108 East Tomichi Avenue, which is on the corner of Main Street and Tomichi Avenue. The existing tower is 22' total height, along the north property line. The request is to replace the tower up to the maximum height allowed which would be approximately a 38-foot tall tower on the top oft the building. The applicant is Jason Swenson along with business partner Viaero representative Kyle DeNardo. Kyle made the presentation on behalf of Jason, and also presented the specifications for the Viaero Wireless micro cell wireless antennas. Kyle stated that the wireless micro site would allow them to have better coverage in Gunnison and iti is their intent to place two more micro cell sites at currently undetermined locations. The antennas that are placed on the tower will be somewhat determined by the wind load on the tower. Kyle showed the Commission what the site currently looks like with the existing tower and a simulation of what it would look like with the installation oft the new and for Viaero Wireless to install a micro cell wireless antennas. tower. January 9, 2019, Commissioner Perusek moved, Commissioner Iverson seconded and the Planning and Zoning Commission voted to. APPROVE Conditional Use application, CU 18-7, submitted by Jason Swenson, Internet Colorado, to replace the existing tower with a new elecommunications tower and equipment that is roof mounted at 108 East Tomichi Avenue, with the following findings of fact and conditions: Findings of Fact: 1. The Planning and Zoning Commission finds that the record of this action includes the application contents on file with the City of Gunnison; all comments entered into the Public Hearing record; and provisions of the CityofGumnison Land Development 2. The Planning and Zoning Commission finds that this application is for a Conditional Use to replace the existing 28-foot-high elecommunications tower with a new tower, equipment for broadband redundancy and micro cell antennae in the CBD zone 3.
