REMOTE MEETING FINDINGS. City Attorney Nelson stated. AB 361 mentioned at last couple meetings, this is the bill that was signed by the Governor last month that extends the remote meeting requirements that have been in place in the prior Governor's Executive Order with a couple changes; most importantly, it requires that Agencies the first time they meet remotely in this format, and within every 30 days thereafter to: make certain findings and those findings are that social distancing is recommended by state and local health officials and/or that meeting inj person presents imminent risk to the health and safety of attendees. We already set this up as an AB 361 meeting, given what happened with the roofincident at the Civic Center. To allow us to proceed remotely this meeting would request that Council makes these findings by motion. No legal action is Sweeper still down, in Sutter Creek for repair. This weekend the PW crew did a good job keeping the drains cleared. Did not have any major Received a call from JPD regards to a down across the creek behind South Ave. Reached out to ChiefMackey and their crew showed up. Also reached out to CalFire who brought out a bulldozer as this was a huge tree. The tree caused a dam building water up approximately 5-6ft. flooding. There was no other way this could have been done with CalFire's equipment. 2-3 meetings ago ai resident came in to voice his concerns Jackson Elementary on Church St. regarding signage. Has been working with Chief Mynderup on the needed signage. Will be putting a school zone sign up, a crosswalk sign, and a 25 mph on Church St. The COJ's Skate Park is up and running. Kids are enjoying it and respecting the rules. Will work on the trash issue. Has had a good turnout. They are working on the times it will be open, Keith Sweet approached him and would like to get a piece ofr mining iron and gears that are sitting at the Knight Foundry. There is someone that wants to donate this piece to the City of Jackson. Keith would like to get approval to place this piece in the planter box at the 49er bathrooms. He will get a plaque made to show who it was donated by. This item will be on rainy days it will be closed. discussed later in the agenda. Police Chief. Chris Mynderup Sunday morning, they received reports of4 gunshots heard ini the area Hwy 49/South Ave. Officer Harman was at the Police Department at that time and also heard the shots. The 2nd caller, a Raley' 's employee out on lunch heard the shots, then a short time later he observed a red sedan cruising through the parking lot with a flat tire. Officer Harman responded to the area and stopped the vehicle and contacted the 30-year-old female. She was intoxicated and failed the FST'sa and was arrested with a DUI. Her vehicle was searched; found several rounds of38 special ammo in her purse, additionally a 38-special revolver with 3 spent rounds in the cylinder found in the glove box. She was booked on DUI charges and additional investigation to tiel her JPD will be joining the District Attorney's office, the Victim Witness Bureau. October: is National Domestic Violence month and will join in ai moment of silence for those victims in Amador County who lost their lives. Balloons will be released in honor for each victim who Wednesday evening JPD will be assisting the Argonaut High School for the Downtown Rally. Meeting with Red Cross at Rollingwood Estates this Wednesday to do a Smoke Detector Downtown Rally is this Wednesday before the Big Game is this Friday night at. Amador High. They will be bringing down the Cheerleaders on the Firetruck and will be aj judge for the floats. Outreach. Willl be assisting the Halloween Parade this week. Jackson View Homeowners Association to develop al Hazard Mitigation Plan for them to be ready for next year. Mayor Stimpson stated the Saturday event (escorting of fallen soldier) will be one ofthe highlights of his life. It was a pleasure being involved and recognizing a fallen member of the greatest generation. City Attorney, Josh Nelson - nothing to report. City Manager, Yvonne Kimball - nothing to report. 6. COUNCIL REPORTS. This section is to provide Council members an opportunity to present reports on their activities and to request item be placed on future agendas. Council member McLean Attended ACTC meeting. Although a very long meeting (9a-2p), it was a good presentation and was same company that gave aj presentation to the City on dealing with unfunded liability from Missed the Chamber Board meeting but understood it wasi rescheduled. CM Riebe will fill in for CalPERS. him as he will be on vacation. Council member Riebe ACT was cancelled and rescheduled for November 16, 2021. For the Cemetery, they had a clean-up this past Saturday. Kudo's to CM McLean and Patti Ungaro for showing up along with a few dozen volunteers from the community. There is still quite a bit of work needed. The goal is to schedule 3-4 additional community clean-up daysa a year. Hoping to make improvements to the cemetery before the 100th Anniversary of the Argonaut Mine Disaster. Council member Simmons Attended ACRA meeting; the Oro de Amador project was: mentioned. Justin, ACRA Director, was intrigued by trying to coordinate to pull funding for this project. Chad told him to hold off until we figure out what we need to do for the Tailing Litigation. The report has been turned in Received a call from Dana Calhoun from American Legion regarding the Veteran'sl Day Parade and wanted to know: ifs she can hang their Banner on Main St. He found out from Bree Wilder regarding the new process and will go to City Hall and pick up the Banner Request Form and he and will find out soon. will drop off banner at City Hall. Mayor Stimpson Attended a couple meetings, not much to report on them yet. Had a meeting with Supervisor, Pat Crew today to discuss some different items ini relations to the City and the County. 7. DISCUSSION CALENDAR. For the: record: Action minutes provide the necessary documentation of City Council actions and audio recordings are retained for those desiring more detail on particular agenda item discussion. These audio recordings provide an accurate and comprehensive backup of City Council deliberations and citizen discussion. a. Discussion on whether to continue to allow temporary outdoor dining on Main St. as related to Rosebuds Restaurant's request and possible direction to provide parameters for continued accommodation. City Manager Kimball explained that to help businesses overcome COVID restrictions, city agreed for restaurants to use city Right of Ways for outdoor dining arrangements. That started in March 2020. The restrictions have eased, and most restaurants do need the accommodation anymore. Rosebuds Café would like to continue the arrangement. Rosebuds only use the CM McLean said he had no problem with it. He would like us to follow Sutter Creek's model and make it permanent. VM Gonsalves said she and Mayor Stimpson visited restaurants on Main St. when COVID first happened, and she suggested restaurants go outdoor dining. She also felt that the arrangement should be made permanent with Rosebud adding some screening to the tables and chairs sO that the dining area would be more enjoyable. PW Superintendent Bree Wilder said he was concerned about the set up being permanent would interfere with street sweeping and other maintenance work. Mayor Stimpson said that he originally liked the idea of outdoor dining. But he did not want the arrangement to interfere with services, like police and fire and the street maintenance work. CM Simmons said that Sutter Creek has a wider sidewalk Kimball added that Sutter Creek'sn model requires many standards, such as screening for alcohol serving needs and ADA. She said if council wishes to go permanent, we will have to consider the same requirements, which she believes would be al hardship for small businesses to comply. CM McClean asked about the alcohol license. Police ChiefN Mynderup explained that state Alcohol Beverage Commission (ABC) requires a screening for outdoor alcohol consumption. If arestaurant is interested in serving alcohol outdoors, they would need to make an application Kimball summarized that after discussing this with the city planner, building department, police and fire, the recommendation ist to allow the current arrangement until March 31,2021 through an parking spots a few days a week during mid-day. and we do not. with ABC. encroachment process and the city council can discuss what to do then. Both Mary Pulskamp and Tyx PulsKamp thanked council for the discussion and would like to continue the current arrangement as itl has been loved by their customers. Mary also indicated that they are not looking at put up screening around the tables as they do not have manpower to do SO. Hearing no more public comment. Mayor brought it back for a motion. Motion to approve Option 1 to soft date of March 315, 2022, with requirement of encroachment permit, October 25, 2021, as presented. Possible contract award to Allied Construction for the City Hall roof project. Mayor opened the discussion by advising everyone that the roof leaked SO bad that he felt that this meeting had tol be conducted virtually. He then asked City Manager Kimball to give some. details. Kimball stated that city has been working on the leaky roof for several years. City spent some money to fix the worst areas a couple ofyears ago. This year the rest oft the roofjob was bidded out three times. The first time we got one bid and was around $500,000 for everything, from outside, to inside ceiling tiles and flooring. Then staff reduced the scope and rebid. We only received one bid also. Shortly after that, the city was told that we received around $76,000 in the CDBG grant that can be used towards the roof. We: rebid the third time to meet CDBG requirements. As ai result, we received 2 bids. Staffrecommends awarding the contract, CM McLean asked how much grants altogether are available to this project and what the restrictions are. Kimball said there were two grants - PSPS moneys and the CDBG CV. She explained that the PSPS money is designed to make the civic center accessible to use during future black out days. The CDBG money is supposed to make the facility available for covid related services. The services need to focus on low income and unhoused individuals. VM Gonsalves asked whether other contractors can still bid on it now. City Attorney Nelson said no, the city would have to start the process again in order to invite more contractors to bid. VM Gonsalves said that she was disappointed in the number of bids we received and wished we had reached out to additional contractors. Mayor Stimpson said it's hard to find contractors to bid and the prevailing wage requirement is hard to meet for smaller outfit. Manager Kimball agreed and told Council that staff used ai multitude of ways to spread the word. Many contractors looked at the invitation, but decided not to bid, perhaps due to the wage requirements CM Simmons said the roofneeds to be taken care of as soon as possible. He said we should do more, like the outside ceiling. City Manager Kimball said she agrees, but the fund is an issue. including alternate projects, to the low bidder Allied Construction. and labor shortage. City Manager Kimball stated former Council member Keith Sweet approached the City with a piece ofiron mining equipment suggesting toj place at the 49er Restrooms. Kimball turned over thisi item to Keith Sweet. Mr. Sweet provided the background of how this piece became available from the Knight Foundry along with a plaque reflecting the donor.
